CITY OF SANTA ANA <br />RFP No. 20-160 BOND AND VALIDATION COUNCEL SERVICES Page 7 of 26 <br /> <br />Subcontractors must comply with the City’s insurance requirements as stated herein. <br />Primary Contractor shall not allow any Subcontractor to commence work until all <br />insurance required of Subcontractor is obtained. <br />Additionally, Contractor shall provide the following insurance coverage: <br />A warrant that the firm maintains a prudent amount of errors and omissions <br />insurance that covers negligent acts and is applicable to the work requested <br />in this RFP. <br />Work on the contract shall not begin until after the awarded Contractor has submitted <br />acceptable evidence of the required insurance coverages. <br /> <br /> <br />VII. SELECTION PROCEDURES & CRITERIA <br />A. The City will establish a proposal review committee, consisting of Finance staff designated <br />by the Executive Director of Finance and Management Services. The review committee <br />will evaluate proposals based on the response to the RFP, which includes adherence to <br />outlined directions and format, and the City evaluation criteria set forth above. <br /> <br />B. Proposers will be ranked by Finance staff based on the following criteria: <br /> <br /> Experience with POB Transactions, including validation actions <br /> Cost Proposal <br /> Overall Quality of Response <br /> Response to Interview Questions (if needed) <br /> <br />Proposals are evaluated to determine which firms are best qualified, and their proposals <br />are within a competitive range. Discussions and negotiations may then be carried out <br />with proposer(s) within the competitive range. <br />A final score will be calculated for each submitted proposal and used to rank Proposers. <br />The City is under no obligation to accept any proposal and reserves the right to negotiate. <br /> <br />C. The City shall not be obligated to accept the lowest priced proposal, but will make an <br />award in the best interests of the City of Santa Ana after all factors have been evaluated. <br />The City will select counsel based upon staff/advisor evaluation and recommendation, <br />which will then be submitted to the City Council for approval. <br /> <br />D. The City reserves the right to disqualify a proposal based on any detailed cost estimate <br />with mathematical or clerical errors, inconsistencies, or missing information that prevents <br />the City from fully evaluating the proposal. The City, but is not required to, seek <br />clarification from a firm regarding information in a proposal. Errors and ambiguities in <br />proposals will be interpreted in favor of the City. <br />. <br />VIII. WITHDRAWALS <br />Proposers are responsible for verifying all prices and information before submitting a proposal. <br />Prior to the proposal due date, the Proposer or Proposer’s representative may withdraw the
