NS-XXX <br /> <br /> <br />ZONING ORDINANCE AMENDMENT NO. 2022-04 – AN <br />ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA AMENDING SECTIONS 41-130, 41-522 AND <br />41-1341 OF, AND ADDING SECTION 41-130.5 AND <br />ARTICLE XXI (OUTDOOR DINING ON PRIVATE <br />PROPERTY) TO, CHAPTER 41 (ZONING) OF THE SANTA <br />ANA MUNICIPAL CODE ESTABLISHING REGULATIONS <br />RELATING TO THE PLACEMENT, DEVELOPMENT, AND <br />OPERATION OF OUTDOOR DINING ON PRIVATE <br />PROPERTY <br /> <br /> <br />THE CITY COUNCIL OF THE CITY OF SANTA ANA HEREBY ORDAINS AS <br />FOLLOWS: <br /> <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines <br />and, declares as follows: <br /> <br />A. On March 17, 2020, the City Council proclaimed the existence of a local <br />emergency to ensure the availability of mutual aid and support an effective <br />response to the novel coronavirus (“COVID-19”) pandemic. <br /> <br />B. On May 8, 2020, the state moved into Stage 2 of the California Resilience <br />Roadmap, which allowed non-essential retail businesses and restaurants <br />to reopen for curbside pickups and deliveries. <br /> <br />C. On May 23, 2020, the County of Orange announced the State’s approval <br />of the County’s plan to accelerate local businesses further into Stage 2 of <br />the California Resilience Roadmap. <br /> <br />D. On May 28, 2020, the City Manager, acting as Director of Emergency <br />Services, approved Executive Order No. 5-2020 allowing restaurants and <br />retail businesses to temporarily use public and private sidewalks and <br />parking spaces for outdoor dining and retail operations to help stimulate <br />the economy. In addition, the City Manager issued and published written <br />guidelines (“A Guide for Outdoor Business Operations”) providing <br />guidance and safety measures for businesses to implement. <br /> <br />E. On December 15, 2020, the Orange County Board of Supervisors <br />awarded a $500,000 grant to the City for the use of developing safe <br />outdoor dining opportunities for businesses along or within 500 feet of <br />First Street and Seventeenth Street. The City utilized the grant money to <br />retain a vendor to design, construct, and install 22 outdoor dining parklets <br />for restaurants located on private property. Parklets included tables, <br />chairs, bistro lights, railings, planters, drought resistant tolerant plants, <br />umbrellas, shade sails, roman shades, and painted flooring or wood, and <br />cement decks.
