NS-XXX <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY <br />OF SANTA ANA, CALIFORNIA, AMENDING SECTION 36- <br />400 OF CHAPTER 36 OF THE SANTA ANA MUNICIPAL <br />CODE REGARDING THE LOCATION OF PARKING <br />METERS <br /> <br />THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1. The City Council of the City of Santa Ana hereby finds, determines, <br />and declares as follows: <br /> <br />A. Currently, Santa Ana Municipal Code Section 36-400 requires all <br />parking meters to be placed upon the curb alongside of and next to <br />parking spaces; <br /> <br />B. Class IV (protected) bikeways have a raised median separating the <br />parking space and the bikeway from the sidewalk; and <br /> <br />C. The use of protected bikeways requires modification of Santa Ana <br />Municipal Code Section 36-400 to allow parking meters to be placed on <br />the sidewalk adjacent to parking spaces. <br /> <br />Section 2. Section 36-400 of Article VIII entitled “Parking Meters” of Chapter 36 <br />of the Santa Ana Municipal Code is hereby amended to read as follows (new language <br />is underlined and deleted language is stricken): <br /> <br /> Sec. 36-400. - Location on sidewalk; space markings. <br /> <br /> All parking meters shall be placed upon the sidewalk alongside of adjacent parking <br />spaces or next to parking spaces. Such parking spaces shall be of sufficient size to <br />accommodate an automobile and shall indicate parallel or diagonal parking by painted <br />lines on the pavement. <br /> <br /> <br />Section 3. If any section, subsection, sentence, clause, phrase or portion of this <br />ordinance is for any reason held to be invalid or unconstitutional by the decision of any <br />court of competent jurisdiction, such decision shall not affect the validity of the <br />remaining portions of this ordinance. The City Council of the City of Santa Ana hereby <br />declares that it would have adopted this ordinance and each section, subsection, <br />sentence, clause, phrase or portion thereof irrespective of the fact that any one or more <br />sections, subsections, sentences, clauses, phrases, or portions be declared invalid or <br />unconstitutional. <br />
