TO PROVIDE ON -CALL STORMWATER PROJECT <br />'05f't DESIGN SERVICES <br />THIS FIRST AMENDMENT to the above -referenced agreement is entered into on August 15, <br />2023, by and between Tetra Tech, Inc. ("Consultant"), and the City of Santa Ana, a charter city <br />and municipal corporation organized and existing under the Constitution and laws of the State of <br />California ("City"). <br />:v <br />L� RECITALS <br />N <br />A. The parties entered into Agreement No. A-2020-205-01, dated October 20, 2020, by which <br />Consultant agreed to provide on -call stormwater project design services ("Agreement"). <br />The original term of the Agreement was for three years, with provision for one, two-year <br />extension period. <br />B. The parties now wish to amend the Agreement to increase the total expenditure amount for <br />the remaining term of the Agreement and to exercise the optional two-year extension period. <br />The Parties therefore agree: <br />Section 2, Compensation, is amended to increase the not -to -exceed expenditure under the <br />Agreement from $2,000,000.00 to $4,000,000.00 for the remaining term of the Agreement, <br />including the optional two-year extension period. <br />2. Pursuant to Section 3 of the Agreement, Term, the time period of the Agreement is extended <br />for the additional two-year term which shall now end on October 19, 2025. <br />3. Except as modified by this First Amendment, all terms and conditions of the Agreement shall <br />remain in full force and effect. <br />[Signatures appear on following page) <br />Page 1 of 2 <br />
