DOWDALL LAW OFFICES <br />A PROFESSIONAL CORPORATION <br />ATTORNEYS AT LAW <br />City of Santa Ana <br />August 28, 2023 <br />Page 22 <br />444 (2d Cir.1988), cert. denied, 489 U.S. 1065 (1989), the court issued a housing remedy order, <br />which included mandatory and discretionary construction of public housing. City defaulted on <br />the order. Government then entered into a consent judgment with city and council members, <br />which required implementing remedial legislation. When they failed to act on a clear <br />constitutional requirement, the court held them in contempt, with punishment including <br />incarceration. U.S. v. Yonkers (2d Cir. 1988) 856 F.2d 444, 446. <br />The proposed ordinance is the enemy of every American ideal of electoral and political <br />freedoms. It is not consistent with the principles of the Republic envisioned by the founding <br />fathers and embedded in the Constitution. It is a violent rejection of the appropriate tools to <br />govern in a free and open society. The proposed ordinance must be squelched so that the council <br />is not in a position of violating the rights of free American subject to the laws of the city of in <br />Santa Ana. <br />Voting in favor of the proposed ordinance would violate the Santa Ana charter. Passing <br />the proposed ordinance would be a void de facto amendment of the charter for rent control <br />ordinances. Passing the proposed ordinance would usurp the right of the people to determine the <br />existence of grounds or justifications for any change to the Santa Ana charter. <br />Setting a precedent for the punishment and discrimination against minority interests by <br />official citywide political action may single out the city of Santa Ana as a shining example of the <br />corrosion of a fair and open democracy in our world. <br />With all respect, demand is hereby made to reject this patently unconstitutional proposal. <br />The proposal would clearly inflict constitutional damage upon the mobilehome park owners in <br />the city of Santa Ana and upon every voter deprived of the powers vested by the California <br />Constitution and the City Charter. <br />Please further note this letter constitutes a demand for the preservation of all writings <br />with relate to the issue of rent control in the city of Santa Ana including the documents, <br />correspondence, electronic mail, and all other writings which relate to Santa Ana rent control. <br />Dowdall Law Offices, A.P.C. <br />Terry R.
