Passing this amendment with new voting thresholds without <br />amending your charter is a violation of your charter which is a misdemeanor. <br />This is also a violation of state law. Government Code 36936: <br />Resolutions, orders for the payment of money, and all ordinances require a recorded majority <br />vote of the total membership of the city council. (Gov. Code, § 36936 (Deering, Lexis Advance <br />through the 2023 Extra Session Ch 1, 2023 Regular Session Ch. 130).) <br />Industry representatives have been asked by the city to come to the table and "work together" to <br />implement this rent control ordinance and regulations on rental housing. Stunts like this <br />discussion item show that the city is not earnest in a desire to work with all stakeholders. Instead, <br />the council majority and city staff put their collective thumb on the scale in favor of tenants time <br />and time again: passing the most onerous, sub -inflationary rent control ordinance in the state, <br />stacking the make-up of the rent board with more tenants than property owners and <br />independent members, and now attempting to handcuff future council's ability to make changes <br />to the rent control ordinance. This will draw the city into more litigation and is a pure power grab <br />by a tyrant majority of the council. It sends a very clear message to property owners. <br />This council is fully aware of the legal risks and challenges this change will invite.
