RESOLUTION NO. 2023-058 <br />A RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA AFFIRMING A POSITIVE CITY <br />ATTORNEY EVALUATION AND ACKNOWLEDGING A <br />RETAINER INCREASE PURSUANT TO THE <br />EXISTING RESTATED LEGAL SERVICES <br />AGREEMENT FOR CITY ATTORNEY SERVICES <br />WHEREAS, on or about April 2012, the City of Santa Ana entered into an <br />agreement with Best Best & Krieger LLP for City Attorney and additional special counsel <br />services, and later amended and restated the agreement in 2014 and 2021 ("2021 <br />Restated Legal Services Agreement'); and <br />WHEREAS, the City Charter and 2021 Restated Legal Services Agreement <br />provide that the City Council shall conduct an annual performance evaluation of the City <br />Attorney; and <br />WHEREAS, the City Council conducted such an evaluation, resulting in a positive <br />performance appraisal; and <br />WHEREAS, the 2021 Restated Legal Services Agreement provides for an <br />automatic retainer increase upon a positive performance evaluation. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa <br />Ana as follows: <br />Section 1. On August 15, 2023, the City Council completed the City Attorney <br />evaluation and approved an "exceeds expectation" rating. Pursuant to the terms of the <br />2021 Restated Legal Services Agreement, the annual retainer is automatically increased <br />by $25,000. <br />Section 2.
