1I: Procedure for Filing Arbitration: <br />1. Students are strongly encouraged, but not required, to utilize the first two steps of the <br />grievance procedure described above, prior to filing arbitration. <br />2. A student desiring to file arbitration should first contact the Chief Executive Officer of <br />Student Affairs, who will provide the student with a copy of the BBB rules at no cost. A <br />student desiring to file arbitration should then contact the BBB, which will provide the <br />appropriate forms and detailed instructions. The student should bring this form to the BBB. <br />3. A student may, but need not to, be represented by an attorney at the Arbitration. <br />Acknowledgment of Waiver of Jury Trial and Availability BBB Rules: By signing the <br />Enrollment Agreement, each party understands the nature of arbitration; that arbitration is final <br />and binding, and each party is waiving certain rights, including, but not limited to, its right to <br />litigate its dispute in court, including its right to a jury trial. Both parties understand that the <br />award of the arbitrator will be binding and not merely advisory. <br />The university complies with the Americans with Disabilities Act of 1990 and Section 504 of the <br />Federal Rehabilitation Act of 1973. Accordingly, qualified persons with disabilities cannot, on <br />the basis of disability, be denied admission or subjected to discrimination in admission decisions. <br />Further, no qualified disabled student may be excluded from any academic, research, counseling, <br />financial aid, or other post -secondary education program or activity that the University provides <br />to all students on the basis of that student's disability. <br />Students are expected to conduct themselves in a responsible manner that reflects generally <br />accepted moral standards, honor, and good citizenship. They are also expected to abide by the <br />regulations of the University. It is the student's responsibility to maintain academic honesty and <br />integrity and to manifest a commitment to the goals of the University through proper conduct <br />and behavior. Any form of academic dishonesty, or inappropriate conduct by students or <br />applicants, may result in penalties ranging from a warning to dismissal as deemed by CSTU. <br />Any such disciplinary action will be taken following the procedures of due process. Due process <br />mandates that students be given notice and an opportunity to be heard, that is, informed in <br />writing of the nature of the charges against them and provided with an administrative hearing on <br />the issues and provisions for appeal. <br />Page 25 of 65 <br />
