Resolution No. 2023-15 <br />Page 1 of 9 <br />RESOLUTION NO. 2023-15 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE <br />CITY OF SANTA ANA APPROVING CONDITIONAL USE <br />PERMIT NO. 2023-14 AS CONDITIONED TO THE SALE OF <br />ALCOHOLIC BEVERAGES for ON- <br />PREMISES CONSUMPTION AT FAT OF THE LAND <br />LOCATED AT 700 NORTH MAIN STREET, UNIT A <br />BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF SANTA <br />ANA AS FOLLOWS: <br />Section 1. The Planning Commission of the City of Santa Ana hereby finds, <br />determines, and declares as follows: <br />A.Robert Paetz, business owner of Fat of the Land, LLC. (“Applicant”) and on <br />behalf of Jacqueline Poladian and The Jacqueline Poladian Living Trust <br />(“Property Owners”), is requesting approval of Conditional Use Permit (“CUP”) <br />No. 2023-14 to allow the sale of alcoholic beverages for on-premises <br />consumption at a new eating establishment located at 700 North Main Street, <br />Unit A. <br />B.Section 41-196 of the Santa Ana Municipal Code (“SAMC”) requires approval <br />of a CUP for establishments wishing to sell alcoholic beverages for on- <br />premises consumption. <br />C.The proposed eating establishment will meet all required standards specified <br />by Section 41-196 of the SAMC and the State Department of Alcoholic <br />Beverage Control (“ABC”) for the sale of alcoholic beverages for on-premises <br />consumption by containing a full kitchen and a menu of hot and cold food items <br />for purchase. <br />D.On July 10, 2023, the Planning Commission held a duly-noticed public hearing <br />on CUP No. 2023-14. <br />E.The Planning Commission of the City of Santa Ana determines that the <br />following findings, which must be established in order to grant a CUP pursuant <br />to Section 41-638 of the SAMC, have been established for CUP No. 2023-14 <br />to allow the sale of alcoholic beverages for on-premises consumption at a new <br />eating establishment located at 700 North Main Street, Unit A. <br />1.That the proposed use will provide a service or facility which will <br />contribute to the general wellbeing of the neighborhood or community. <br />The sale of alcoholic beverages for on-premises consumption at this <br />location will provide an ancillary service to the eating establishment’s <br />customers by allowing them to purchase alcoholic beverages with their
