5.5 Standby Pay <br />A. Standby Defined <br />An employee who is released from active duty, but is required by their department <br />to leave notice where they can be reached and be available to return to active duty <br />at any time other than their regularly scheduled working hours, shall be said to be <br />on standby duty. <br />B. Requirements of Standby <br />Employees in the unit may be required to be on standby for many different reasons. <br />Being on standby means that the employee is required to: <br />Be accessible by phone, email or text; <br />Promptly return to work after being called, emailed or texted; <br />Remain fit for duty and able to respond. Employees are not permitted to <br />drink alcohol while on standby duty. <br />Employees on standby shall receive a cell phone from the City and will be required <br />to respond to the call or text as quickly as possible. Upon responding to the call or <br />text, the employee will be instructed as to whether they is required to return to work <br />and will be informed of the location to which they must respond. Response time <br />will generally be the employee's normal commute time to the City and the minimal <br />time necessary for the employee to get ready to return to work. <br />C. Compensation Rates for Standby <br />1. Weekly Rate <br />An employee shall receive four hundred and fifty dollars ($450.00) per week <br />when assigned to be on standby duty. <br />2. Daily Rate <br />Employees who trade days, or partial days, will have that time deducted from <br />their pay on a prorated daily rate, which may be prorated to an hourly rate of <br />three dollars and fifty-two cents ($3.52), based on a seven (7) day week or one <br />hundred and twenty-eight (128) hours. Employees who cover the day or hours <br />shall be paid at the prorated rate. <br />All trades must be approved by the Supervisor or Manager. <br />3. In addition to Standby Pay, if an employee is able to handle the incident by <br />phone or other electronic means without reporting to duty, they shall be entitled <br />2022-2025 MOU City of Santa Ana & SEIU Full -Time Employees Unit Page 23 <br />
