2. A subpoenaed employee scheduled to appear in court (including but not <br />limited to depositions, meetings, and interviews) on City business during off - <br />duty time may be placed in a standby status by the Department Head or their <br />authorized representative if the employee can respond to the court, if called, <br />within sixty (60) minutes of the employee's notification. <br />In the event such off -duty employee is on standby status during any court <br />session and is not required to appear in court, such employee shall be <br />compensated two (2) hours on a straight time basis, for each said court session. <br />With the approval of the Department Head, the employee may elect, in lieu of <br />paid time, to take two (2) hours of compensatory time off for the standby time <br />and not appearing in court. <br />If such off -duty employee on standby actually appears in court, they shall be <br />compensated as provided in Section 10.11(A)(1). <br />B. Jury or Witness <br />1. When an on -duty employee is called to serve as a juror or non-party witness <br />in any court action, they shall be allowed to leave for the time actually required <br />for such service without loss of pay. <br />Each on -duty employee called for such service shall present their Department <br />Head the jury summons or subpoena calling them to such service and shall pay <br />into the City Treasury the fees collected for such service, excluding any <br />reimbursement for mileage expenses. <br />An employee on jury duty who is released from jury duty by the court may <br />take off for the rest of their workday if taking into consideration the time it <br />would take to travel back to work, there would still be two (2) hours or less <br />left on their shift. If there would be more than two (2) hours left in their shift <br />at the time they would arrive at work, the employee must return to work or call <br />in to their supervisor and ask to use leave to cover the rest of their shift. <br />2. If an employee is called to serve on jury duty during a normal day off or on a <br />City holiday, then the jury duty shall be considered the same as having <br />occurred during the employee's regular day off work; therefore, the employee <br />will receive no added compensation. <br />2022-2025 MOU City of Santa Ana & SEIU Full -Time Employees Unit Page 60 <br />
