c. Upon written request of the Union, the Department Director of the President <br />will schedule the President to be offsite for half of each workday to conduct <br />union business. The Department Director shall schedule the President to be <br />onsite working on City business each half day of each normal work week. <br />The Department Director may change the schedule of the President upon <br />reasonable notice to the employee. <br />d. During the period of time the President is performing City work, they shall <br />receive no union -related phone calls or visitors. Persons who call or wish to <br />see the President regarding union -related matters during their work time <br />shall be referred to the Union's offsite office. <br />e. Time spent by the President on Chapter Chair/President's Leave shall not <br />be considered time worked for the computation of overtime according to the <br />FLSA. <br />f. The Union shall reimburse the City for one hundred percent (100%) of the <br />employee's salary, including any premium payments and benefit costs, for <br />the Chapter Chair/President's Leave time. <br />The Union agrees to pay for Union Business Leave and Chapter <br />Chair/President's Leave within thirty (30) calendar days of receipt of the <br />bill from the City. The bill will be sent on a monthly basis. <br />If the bill is not paid within thirty (30) calendar days of receipt, the City <br />shall deduct such amount from the union dues collected from the employees <br />on behalf of the Union. In the event a portion of the bill is rightfully <br />contested, the City shall only deduct the non -contested portion from the <br />union dues. <br />Any issues related to the bill must be brought to the attention of the <br />Executive Director of Human Resources within fifteen (15) calendar days <br />of its receipt and must be resolved within the remaining fifteen (15) calendar <br />days, so that the bills are paid in a timely manner or within thirty (30) <br />calendar days of its receipt. <br />2. Evidence of Insurance <br />a. The Union shall provide an insurance policy or policies, or certificate of <br />such insurance, naming the City, its officers and employees as insured or <br />additional insured which provides coverage against liability for any and all <br />claims and/or suits for damages or injuries to persons or property resulting <br />from or arising out of any act or omission of said union representative. Said <br />policy or policies of insurance shall provide coverage for both bodily injury <br />and property damage not less than the following minimum amounts: one <br />2022-2025 MOU City of Santa Ana & SEIU Full -Time Employees Unit Page 76 <br />
