RESOLUTION NO. 2023-XXX <br />RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA CALLING AND GIVING NOTICE OF A <br />GENERAL MUNICIPAL ELECTION TO BE HELD IN THE <br />CITY OF SANTA ANA ON NOVEMBER 5, 2024 FOR THE <br />SUBMISSION OF A BALLOT MEASURE TO THE <br />QUALIFIED VOTERS PROPOSING A RENT <br />STABILIZATION AND JUST CAUSE EVICTION <br />ORDINANCE AND REQUESTING THE ORANGE COUNTY <br />BOARD OF SUPERVISORS TO CONSOLIDATE THIS <br />ELECTION WITH THE STATEWIDE GENERAL ELECTION <br />WHEREAS, on October 19, 2021, pursuant to the City of Santa Ana's police <br />powers under Charter Section 200 and Article XI, Section 7 of the California Constitution, <br />the Santa Ana City Council adopted Ordinance No. NS-3009 known as the Rent <br />Stabilization Ordinance ("RSO") and Ordinance No. NS-3010 known as the Just Cause <br />Eviction Ordinance ("JCEO"). At the time, these Ordinances were codified in Article X of <br />the Santa Ana Municipal Code in Division 4 (RSO) and Division 5 (JCEO); <br />WHEREAS, on October 19, 2021, the Santa Ana City Council also adopted <br />Resolution No. 2021-054 directing staff to (1) conduct further study of the regulatory <br />framework and infrastructure necessary to implement residential rent stabilization, just <br />cause eviction, and other protections for Santa Ana residents facing housing instability; <br />and (2) include the creation and operation of a Rent Board or similar body, a rent registry, <br />and the related costs thereof; <br />WHEREAS, on September 6, 2022, staff presented the Long -Term <br />Implementation Plan for the RSO and JCEO ("The Plan") to the City Council. The Plan <br />detailed various best practices based on findings from local sample jurisdictions in <br />California with similar ordinances; <br />WHEREAS, on September 6, 2022, the Santa Ana City Council adopted The Plan <br />and provided direction to staff to prepare amendments to the RSO and JCEO to <br />implement efficient and effective program services to rental property owners and tenants <br />and to promote long-term sustainability of the programs; <br />WHEREAS, On October 18, 2022, the City Council adopted Ordinance No. NS- <br />3027 which moved the RSO and JCEO from Article X of the Santa Ana Municipal Code <br />to Article XIX of the Santa Ana Municipal Code. Ordinance No. NS-3027 also amended <br />the RSO and JCEO to include provisions consistent with The Plan including, but not <br />limited to, creation of a Rental Housing Board and Rental Registry ("The Council <br />Ordinance"); <br />Resolution No. 2023-XXX <br />Page 1 of 5 <br />
