the CITY. This provision also applies to the Instructor's Workers' Compensation <br />policy. <br />d. Each insurance policy required above shall provide that coverage shall not be <br />canceled,except with notice to the CITY. <br />(5) Acceptability of Insurers <br />Insurance is to be placed with insurers authorized to conduct business in the state with a <br />current A.M. Best's rating of no less than A: VII, unless otherwise acceptable to the <br />CITY. <br />(6) Verification of Coverage <br />SUBRECIPIENT shall furnish the CITY with original Certificates of Insurance including <br />all required amendatory endorsements (or copies of the applicable policy language <br />effecting coverage required by this clause) and a copy of the Declarations and <br />Endorsement Page of the CGL policy listing all policy endorsements to CITY before <br />work begins. The CITY reserves the right to require complete, certified copies of all <br />required insurance policies, including endorsements affecting the coverage required by <br />these specifications, at any time. <br />(7) Special Events Coverage for Instructors <br />Special events coverage is available for an additional fee to provide the liability insurance <br />required by this agreement. SUBRECIPIENT can obtain additional information and cost <br />from the CITY. <br />(8) Special or Low Risk Activities <br />CITY reserves the right to modify these requirements, including limits, based on the <br />nature of the risk, prior experience, insurer, coverage, or other special circumstances. The <br />CITY reserves the right to modify or waive insurance requirements for certain low risk <br />recreational activities. <br />K. Zoning. <br />The SUBRECIPIENT agrees that any facility/property used in furtherance of said program shall be <br />specifically zoned and permitted for such use(s) and activity(ies). Should the SUBRECIPIENT fail to <br />have the required land entitlement and/or permits, thus violating any local, state, or federal rules and <br />regulations relating thereto, the SUBRECIPIENT shall immediately make good -faith efforts to gain <br />compliance with local, state, or federal rules and regulations following written notification of said <br />violation(s) from the CITY or other authorized citing agency. The SUBRECIPIENT shall notify the <br />CITY immediately of any pending violations. Failure to notify the CITY of pending violations, or to <br />remedy such known violation(s), shall result in termination of grant funding hereunder. The <br />SUBRECIPIENT must make all corrections required to bring the facility/property into compliance <br />with the law within sixty (60) days of notification of the violation(s); failure to gain compliance <br />within such time shall result in termination of grant funding hereunder. <br />
