Resolution No. 2023-XXX <br />Page 1 of 3 <br /> <br />RESOLUTION NO. 2023-XXX <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA <br />ANA AUTHORIZING AN APPLICATION TO THE STATE WATER <br />RESOURCES CONTROL BOARD FOR FINANCIAL ASSISTANCE <br />FOR THE WELLS 27 AND 28 PFAS TREATMENT SYSTEM <br />PROJECT <br /> <br /> <br /> WHEREAS, the California State Water Research Control Board Drinking Water <br />State Revolving Fund provides financial assistance to reduce people’s exposure to per- <br />and polyfluoroalkyl substances (“PFAS”) and other emerging contaminants through their <br />drinking water; and <br /> <br />WHEREAS, due to the presence of PFAS found in routine well monitoring, several <br />wells in the Orange County Water Basin have been taken offline, including the City’s Well <br />27 and Well 28; and <br /> <br />WHEREAS, on May 19, 2020, City Council approved the PFAS Treatment <br />Facilities and Program Agreement (“PFAS Agreement”) with the Orange County Water <br />District (“OCWD ”) to provide the funding, design, construction, and operation assistance <br />for PFAS treatment facilities for qualifying City of Santa Ana groundwater wells; and <br /> <br />WHEREAS, per the terms of the PFAS Agreement, the City shall support and <br />assist OCWD to obtain any grants that may be used by OCWD to fund construction and/or <br />future operations and maintenance costs of PFAS treatment systems. <br /> <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Santa <br />Ana as follows: <br /> <br /> Section 1. The Executive Director of the Public Works Agency (the “Authorized <br />Representative”) or designee is hereby authorized and directed to sign and file, for and <br />on behalf of the City, a Financial Assistance Application for a financing agreement from <br />the State Water Resources Control Board for the planning, design, and construction of <br />the City of Santa Ana Wells 27 and 28 PFAS Treatment System Project. <br /> <br />Section 2. The Authorized Representative, or his/her designee, is designated to <br />provide the assurances, certifications, and commitments required for the financial <br />assistance application, including executing a financial assistance agreement from the <br />State Water Resources Control Board and any amendments or changes thereto. <br /> <br />Section 3. The Authorized Representative, or his/her designee, is designated to <br />represent the City in carrying out the Ci ty’s responsibilities under the financing <br />agreement, including certifying disbursement requests on behalf of the City and <br />compliance with applicable state and federal laws.
