17 <br />As part of those requirements, grant recipients and subrecipients may only use federal funds or funds <br />applied to a cost share for the purposes set forth in this Manual, applicable NOFOs, and the terms and <br />conditions of the award, and those costs and must be consistent with the statutory authority for the award. <br />Federal funds made available through these awards may be used for the purposes set forth in this Manual, <br />the applicable program NOFO, and the terms and conditions of the award and must be consistent with the <br />statutory authority for the award. Grant funds may not be used for matching funds for other federal <br />grants/cooperative agreements, lobbying, or intervention in federal regulatory or adjudicatory <br />proceedings. In addition, federal funds may not be used to sue the federal government or any other <br />government entity. <br />Specific investments made in support of the funding priorities discussed in the appendices to this Manual <br />generally fall into one of the following eight allowable expense categories: <br />1.Construction; <br />2.Equipment; <br />3.Exercises; <br />4.Management & Administration (M&A); <br />5.Organization; <br />6.Operational Activities; <br />7.Planning; and <br />8.Training. <br />Please refer to the relevant program-specific appendix for more information on funding restrictions, <br />funding priorities, and these categories. <br />Accessibility Compliance <br />Preparedness grant program recipients using funds to build or alter buildings must comply with <br />accessibility requirements under the Rehabilitation Act of 1973 and Architectural Barriers Act of 1968 <br />(ABA), as well as the Americans with Disabilities Act (ADA), if applicable, to ensure individuals with <br />disabilities have access to such buildings. Accessibility standards under the ABA and ADA are highly <br />similar. Additional information regarding compliance with the Architectural Barriers Act is available at <br />Chapter 1: Using the ABA Standards (access-board.gov). <br />Authorized Equipment List <br />The Authorized Equipment List (AEL) is a list of approved equipment types allowed under FEMA’s <br />preparedness grant programs. The intended audience of this tool is emergency managers, first responders, <br />and other homeland security professionals. The list consists of equipment categories divided into <br />categories, sub-categories, and then individual equipment items. <br />Prohibitions on Expending Grant or Cooperative Agreement Funds for Certain <br />Telecommunications and Video Surveillance Services or Equipment <br />Recipients and subrecipients of FEMA federal financial assistance are subject to the prohibitions <br />described in section 889 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 <br />(FY 2019 NDAA), Pub. L. No. 115-232 (2018) and 2 C.F.R. §§ 200.216, 200.327, 200.471, and <br />Appendix II to 2 C.F.R. Part 200. Beginning August 13, 2020, the statute – as it applies to FEMA <br />recipients, subrecipients, and their contractors and subcontractors – prohibits obligating or expending <br />federal award funds on certain telecommunications and video surveillance products and contracting with <br />certain entities for national security reasons.
