Public Works Agency <br />https://www.santa-ana.org/pw <br />Item # 26 <br />City of Santa Ana <br />20 Civic Center Plaza, Santa Ana, CA 92701 <br /> Staff Report <br />November 7, 2023 <br />TOPIC: Municipal Facilities License Agreement with T-Mobile West LLC <br />AGENDA TITLE <br />Approve Municipal Facilities License Agreement with T-Mobile West LLC <br />RECOMMENDED ACTION <br />Authorize the City Manager to execute an agreement with T-Mobile West LLC for the <br />use of certain City facilities for a ten-year period, with provisions for two automatic five- <br />year extensions, subject to non-substantive changes approved by the City Manager and <br />City Attorney (Agreement No. 2023-XXX). <br />GOVERNMENT CODE §84308 APPLIES: Yes <br />DISCUSSION <br />In response to telecommunications advancements and increased consumer demand for <br />network data capacity, wireless providers have increasingly sought to place small cell <br />antennas and equipment on existing infrastructure located within the public right-of-way. <br />Typically, a small cell antenna is attached to a streetlight or utility pole, or placed mid- <br />span on wires between utility poles. Wireless providers place these small cells in <br />locations that are densely populated in order to provide additional network capacity, <br />such as in downtown areas and around heavily used traffic corridors. The small cell <br />antennas are also deployed in areas that cannot be effectively served by a traditional <br />macro cell. <br />T-Mobile West LLC seeks to enter into an agreement (Exhibit 1) with the City for the <br />installation of small cell antennas on City-owned street lights. This will increase network <br />and data capacity for their subscribers in the areas surrounding the antennas. <br />The agreement applies only to wireless telecommunications installations on City <br />facilities in the public right-of-way. Installations on City facilities not in the public right-of- <br />way (such as cell antennas placed on water facilities or within parks, etc.), will continue <br />to require separate agreements. <br />An application fee of $1,877 will be collected for each City-owned facility licensed under <br />this agreement during FY 2023-24, after which the fee will be applied based on the City <br />Council-adopted Miscellaneous Fee Schedule for future fiscal years.
