C No C ° FIRST AMENDMENT TO CONSULTANT AGREEMENT WITH VALERIE (0• 0.arkA) MAGDALENO TO PROVIDE LEGISLATIVE SUPPORT SERVICES FOR MAYOR PRO TEM JESSIE LOPEZ THIS FIRST AMENDMENT to the above -referenced agreement is entered into on November 7, 2023, by and between Valerie Magdaleno ("Consultant") and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California ("City"). RECITALS A. The parties entered into Agreement No. N-2023-165 ("Agreement") dated July 1, 2023, to provide legislative support services for Mayor Pro Tern Jessie Lopez. The Agreement term runs until December 31, 2023 and is current and in effect. B. The parties now wish to amend the Agreement to increase the total "not to exceed" amount available under the Agreement, revise the Consultant's hourly rates, memorialize the date at which the City will honor the new hourly rate, and extend the term of the Agreement. No other changes are contemplated by this First Amendment. The Parties therefore agree: 1. Section 2.a., Compensation, is amended to read as follows: City agrees to pay, and Consultant agrees to accept as total payment for Consultant's services for City, the amounts listed in sections 2.b. through 2.f. of this Agreement. The total sum to be expended during the term of this Agreement shall not exceed $50,000.00. 2. Section 2.c., Compensation, is amended to read as follows: All work performed by the Consultant shall be paid for at an hourly rate. The hourly rate to be paid for such work shall be $40.00 per hour. The amounts payable to Consultant shall be computed by multiplying the appropriate hourly rates prescribed in this Agreement by the number of hours worked. City will recognize and compensate Consultant for services provided at this amended rate beginning October 1, 2023. 3. Section 3, Term, is amended to read as follows: This Agreement shall commence on July 1, 2023 and terminate on April 30, 2024, unless terminated earlier in accordance with Section 15, below. 4. Except as modified by this First Amendment, all terms and conditions of the Agreement shall remain in full force and effect.
