INC.. FOR WATER SYSTEM <br />D'. Q COMPUTER MODELING AND LNGINEERING SERVICES <br />War- THIS <br />THIS FIRST AMENDMENT to the above -referenced agreement is entered into on October 3, <br />2023, by and between iWater, Inc., a California corporation ("Consultant'), and the City of Santa <br />Ana, a charter city and municipal corporation organized and existing under the Constitution and <br />laws of the State of California ("City"). <br />RECITALS <br />A. The parties entered into Agreement No. A-2020-049 ("Agreement') dated April 1, 2020, to <br />retain a qualified contractor to provide water system computer modeling and engineering <br />services to the Water Services Division of the Public Works Agency. <br />B. The parties executed the first of two (2) one- (1) year extensions on March 24, 2023 (A- <br />2020-049-01). The Agreement is in full force and effect through March 31, 2024. <br />C. The parties now wish to amend the Agreement to exercise the final extension and increase <br />compensation. <br />The Parties therefore agree: <br />1. Pursuant to the section titled, "Scope of License Grant," of the Agreement, the final extension <br />is hereby exercised for an additional one-year period, from April 1, 2024 through March 31, 2025, <br />Any insurance certificates are required to be extended and/or renewed to cover this final extension. <br />2. Pursuant to the "Contract Total," in Exhibit A of the Agreement, the compensation is hereby <br />amended to increase annual compensation by $120,000 for the remainder of the Agreement. <br />3.
