RESOLUTION NO. 2023-085 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA SUMMARILY VACATING A PORTION OF A <br />PUBLIC RIGHT-OF-WAY EASEMENT ADJACENT TO 1117 <br />SOUTH STANDARD AVENUE (ABANDONMENT NO. 2023- <br />03) <br />WHEREAS, Chapter 4 of the California Streets and Highways Code section 8330 <br />et seq. provides for summary vacation of streets and public service easements; and <br />WHEREAS, California Streets and Highways Code section 8333 authorizes the <br />City Council to summarily vacate public service easements when the easement has been <br />superseded by relocation, or determined to be excess, and there are no other public <br />facilities located within the easements; and <br />WHEREAS, following an earlier finding of conformity with the City's General Plan <br />by the Planning Commission, as reported by the Planning Commission and required <br />under California Government Code section 65042(a), the City desires to vacate its <br />interest in the southerly 4,484- square foot section of the alley adjacent to 1117 South <br />Standard Avenue, as shown on Exhibit A ("Vacation Area"); and <br />WHEREAS, as part of the Planning Commission's approval, they made a <br />stipulation requiring additional community outreach which took place on November 15, <br />2023 at Kennedy Elementary School; and <br />WHEREAS, the property located at 1117 South Standard Avenue in Santa Ana <br />was deeded to the City for the purpose of developing a park; and <br />WHEREAS, on September 19, 2023, the City Council awarded a construction <br />contract to Legion Contractors, Inc. in the amount of $3,366,625 for the construction and <br />completion of the public park; and <br />WHEREAS, the residential apartment complexes located to the north will not be <br />landlocked and have sufficient access from Wakeham Avenue and McFadden Avenue; <br />and <br />WHEREAS, the Vacation Area constitutes an excess right-of-way not required for <br />street purposes; and <br />WHEREAS, the Public Works Agency has conducted an analysis of the subject <br />abandonment and has determined that there are no issues with summarily vacating the <br />Vacation Area presently or in the future, as the Vacation Area will not eliminate public <br />access and will be redesigned/replaced approximately 20 feet to the east and will provide <br />equivalent circulation and function. <br />Resolution No. 2023-085 <br />Page 1 of 4 <br />
