INSURANCE ON FILE A-2023-205 <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />CITYCLERJC, 8 2024 <br />DATE: HIV <br />0_PwAc2) <br />FIRST AMENDMENT TO AGREEMENT TO PROVIDE WASTE DISCHARGE <br />RE'OUMEMENTS COMPLIANCE SERVICES <br />THIS FIRST AMENDMENT to the above -referenced agreement is entered into on November 21, <br />2023, by and between EEC Environmental ("Consultane'), and the City of Santa Ana, a charter <br />city and municipal corporation organized and existing under the Constitution and laws of the State <br />of California ("City"). <br />RECITALS <br />A. The parties entered into Agreement No. A-2021-009, dated January 19, 2021, by which <br />Consultant agreed to provide waste discharge requirements compliance services and general <br />environmental compliance services ("Agreement"). The engagement of Consultant for said <br />services was based on the selection of Consultant's response to City's Request for Proposal <br />No. 20-089. <br />B. The Agreement remains in effect through January 18, 2024, with the provision for an extension <br />of up to one (1) additional two (2) year period. The Agreement is current and in -effect. <br />C. In December 2022, the State of California adopted Statewide General Waste Discharge <br />Requirements for Sanitary Sewer Systems (Water Quality Order No. 2022-0103-DWQ), which <br />requires public agencies that own or operate sanitary sewer systems to develop and implement <br />sewer system management plans and report all sanitary sewer spills to the State Water Board's <br />online database. Water Resources' staff has relied on Consultant to guide the City in ensuring <br />that all reporting requirements are satisfied. Due to these additional requirements mandated <br />by the state, increased funding is needed to compensate Consultant for the additional services <br />provided. <br />D. Since the Agreement was executed, the demand for Fats, Oils, and Grease inspections and <br />Waste Discharge Requirements compliance services has substantially increased because the <br />number of food service establishments in the City continues to grow at a significant rate. <br />E. The parties now wish to amend the Agreement by increasing the amount expended under the <br />Agreement and to extend the term of the Agreement by the additional two (2) year period. <br />The Parties therefore agree: <br />1. Section 2, Compensation, is amended to increase the total compensation to be expended under <br />the Agreement by $250,000.00, for a total amount not to exceed $610,000.00 for the term of <br />the Agreement, including all extension periods, <br />2. Pursuant to Section 3 of the Agreement, Term, the time period of the Agreement is extended <br />for the additional two (2) year term ending on January 18, 2026. <br />3. Except as modified by this First Amendment, all terms and conditions of the Agreement shall <br />remain in full force and effect. <br />Page 1 of 2 <br />
