ADDITIONSIDELETIONS TO CLOSED SESSION <br />City Attorney Sonia Carvalho announced that an immediate need to take action arose <br />following the posting of the agenda regarding two matters <br />1. Conference with Legal Counsel regarding anticipated litigation concerning the urgency <br />ordinance related to Assembly Bill 2011 exemptions. <br />2. Existing administrative matter concerning the Santa Ana Police Officers Association vs. <br />City of Santa Ana regarding an unfair practice charge. <br />MOTION: Councilmember Bacerra moved to add the two items to the Closed <br />Session Agenda, seconded by Councilmember Phan. <br />The motion carried, 5-0-0-2, by the following roll call vote: <br />AYES: COUNCILMEMBER BACERRA, COUNCILMEMBER <br />PENALOZA, COUNCILMEMBER PHAN, <br />COUNCILMEMBER VAZQUEZ, MAYOR AMEZCUA <br />NOES: NONE <br />ABSTAIN: NONE <br />ABSENT: COUNCILMEMBER HERNANDEZ, MAYOR PRO TEM <br />LOPEZ <br />Status: 5-0 0-2- Pass <br />PUBLIC COMMENTS-- Members of the public may address the City Council on Closed <br />Session items. <br />MINUTES: No public comments were received regarding Closed Session agenda Items. <br />CLOSED SESSION ITEMS —The Brown Act permits legislative bodies to discuss certain <br />matters without members of the public present. The City Council finds, based on advice from <br />the City Attorney, that discussion in open session of the following matters will prejudice the <br />position of the City in existing and anticipated litigation: <br />1. CONFERENCE WITH LEGAL COUNSEL — EXISTING LITIGATION pursuant to <br />Paragraph (1) of subdivision (d) of Section 54956.9 of the Government Code: <br />A. Marco Pescina v. City of Santa Ana, United States District Court, Central District of <br />California, Case No. 8:20-cv-0178 CJC (DFMx) <br />B. Stephanie Avila v. City of Santa Ana, et al., Orange County Superior Court, Case <br />No. 30-2020-01131418-CU-PO-CJ C <br />C. Francisco Valencia v. City of Santa Ana, Orange County Superior Court, Case <br />No. 30-2022-01246596-CU-PO-CJ C <br />D. Gerry Serrano v. City of Santa Ana, Santa Ana Police Department, Orange <br />County Superior Court, Case No. 30-2023-01330782-CU-OE-CJC <br />E. Santa Ana Police Officers Association v.
