The Recipient shall comply with civil rights laws <br />including, but not limited to, the Fair Housing Act, the Fair Credit Reporting Act, the Americans <br />with Disabilities Act, Title VII of the Civil Rights Act of 1964, the Equal Educational <br />Opportunities Act, the Age Discrimination in Employment Act, and the Uniform Relocation Act. <br />Such Assurances also include, but are not limited to, the promise to comply with all applicable <br />Federal statutes and orders relating to nondiscrimination in employment, assistance, and housing; <br />the Hatch Act; Federal wage and hour laws and regulations and workplace safety standards; <br />Federal environmental laws and regulations and the Endangered Species Act; and Federal <br />protection of rivers and waterways and historic and archeological preservation. <br />13. COVENANT AGAINST CONTINGENT FEES <br />The Recipient warrants that no person or agency has been employed or retained to solicit or <br />secure this Agreement upon an Agreement or understanding for a commission, percentage, <br />brokerage, or contingent fee, excepting bona fide employees or bona fide offices established and <br />maintained by the Recipient for the purpose of securing Agreements or business. For breach or <br />violation of this warranty, the Government shall have the right to annul this Agreement without <br />liability or, in its discretion, to deduct from the Agreement amount, or otherwise recover, the full <br />amount of such commission, percentage, brokerage, or contingent fee. <br />14. TRAFFICKING VICTIMS PROTECTION ACT OF 2000 (2 CFR 175.15) <br />Trafficking in persons. <br />(a) Provisions applicable to a recipient that is a private entity. You as the recipient, your <br />employees, subrecipients under this award, and subrecipients' employees may not <br />(1) Engage in severe forms of trafficking in persons during the period of time that the award <br />is in effect; <br />(2) Procure a commercial sex act during the period of time that the award is in effect; or <br />(3) Use forced labor in the performance of the award or subawards under the award. <br />(b) We as the Federal awarding agency may unilaterally terminate this award, without penalty, if <br />you or a subrecipient that is a private entity — <br />(1) Is determined to have violated a prohibition in paragraph a.I of this award term; or <br />(2) Has an employee who is determined by the agency official authorized to terminate the <br />award to have violated a prohibition in paragraph a.1 of this award term through conduct <br />that is either: <br />(i) Associated with performance under this award; or <br />(ii) Imputed to you or the subrecipient using the standards and due process for <br />imputing the conduct of an individual to an organization that are provided in <br />2 CFR part 180, "OMB Guidelines to Agencies on Governmentwide Debarment <br />R22AP00055 Agreement Template <br />City of Santa Ana (0112021) <br />
