CLOSED SESSION ITEMS — The Brown Act permits legislative bodies to discuss certain <br />matters without members of the public present. The City Council finds, based on advice from <br />the City Attorney, that discussion in open session of the following matters would prejudice the <br />position of the City in existing and anticipated litigation: <br />1. CONFERENCE WITH LEGAL COUNSEL —INITIATION OF LITIGATION pursuant to <br />paragraph (4) of subdivision (d) of Section 54956.9 of the Government Code: One (1) case <br />Consideration of Amicus Support of Petition for Writ of Certiorari by the City of Costa Mesa <br />to the United States Supreme Courtfor review of the Ninth Circuit Court of Appeals decision <br />in SoCal Recovery, LLC et al. v. City of Costa Mesa, 56 FAth 802 (9th Cir. 2023) <br />2.
