City of Santa Ana Public Works Agency <br />Agreement Number 12-TRANSIT-16 <br />AMS ADV ID: 1224000030 <br />Page 1 of 19 <br />Clean California local Grant Program (State) <br />Restricted Grant Agreement <br />This Restricted Grant Agreement (RGA), between the State of California acting by and through its <br />Department of Transportation, referred to herein as CALTRANS, and the CITY OF SANTA ANA <br />PUBLIC WORKS AGENCY, hereinafter referred to as AGENCY, will commence on September 1, <br />2023, or upon approval by CALTRANS, whichever occurs later. This RGA is of no effect unless <br />approved by CALTRANS. AGENCY shall not receive payment for work performed prior to approval <br />of this RGA and before receipt of Notice to Proceed from CALTRANS. This RGA shall expire on <br />June 30, 2025. <br />Recitals <br />1, Under this RGA, CALTRANS intends to convey State restricted grant funds to AGENCY, <br />pursuant to Budget Act Line Item 2660-130-0001, who will implement the project pursuant to the <br />attached Approved Grant Application and Amendment(s) to Grant Application, Attachment III <br />under the terms, covenants, and conditions of this RGA. <br />2, CALTRANS and AGENCY intend that only funds that are authorized as restricted grants will be <br />subject to this RGA, and that no funds that should be the subject of a Joint Powers Agreement, <br />Interagency Agreement, or other non -grant agreement shall be subject to this RGA. <br />3. WHEREAS, the Clean CA Program, through its Clean CA Local Grants Program, is authorized <br />under California Streets and Highways Code Section 91.41 to provide funding and resources to <br />support local projects that advance the program's goals and objectives; <br />4. WHEREAS, California Streets and Highways Code Section 91.41 provides the legislative <br />authority for the Clean CA Program to advance the following intent and objectives: <br />a. Reduce Waste and Beautify Public Spaces: The primary goal of the program is to allocate <br />grants to local and regional public agencies, transit agencies, and tribal governments to <br />reduce waste and debris within public rights -of -way, tribal lands, parks, pathways, transit <br />centers, and other public spaces. The program aims to enhance, rehabilitate, restore, or <br />install measures to beautify and improve these public spaces, <br />b. Improve Public Health and Community Placemaking: The program seeks to enhance <br />public health, cultural connection, and community placemaking by improving public <br />spaces for walking and recreation. By investing in the improvement of these spaces, it <br />aims to create a positive and welcoming environment for the community. <br />c. Promote Equity for Underserved Communities: The program places a strong emphasis on <br />advancing equity for underserved communities. <br />d. Support Sustainable Practices: The program encourages the implementation of <br />sustainable practices in the beautification and enhancement of public spaces. This <br />includes greening efforts, such as providing shade and reducing the urban heat island <br />effect, as well as using native, low-water plants. <br />e. Engage Local Communities: The program promotes community engagement by requiring <br />project proposals to reflect community priorities. It encourages the involvement of local <br />communities in the development and selection of projects to ensure they meet the needs <br />and preferences of the affected population. <br />f. Prohibit Displacement of Persons Experiencing Homelessness: The program prohibits <br />
