NSURANCE ON FILE N-2022-256A <br />WORK MAY PROCEED <br />UNTIL INSURANCE EXPIRES <br />c-rl;x-p x <br />CITY CLERK pR <br />DATE; A 0 91024 <br />FIRST AMENDMENT TO RECREATION CLASS AGREEMENT <br />WITH MARTINTORRES <br />I�A THIS FIRST AMENDMENT to the above -referenced agreement is entered into on February 26, 2024, <br />by and between Martin Torres ("Provider") and the City of Santa Ana, a charter city and municipal <br />corporation organized and existing under the Constitution and laws of the State of California ("City"). <br />RECITALS <br />A. The parties entered into Agreement No. N-2022-156 ("Agreement") dated September 1, 2022, <br />to provide Karate Do Kiai classes for the City's recreation class program. The Agreement term <br />was extended by the Parties on August 29, 2023 (N-2022-256-01) through June 30, 2024. The <br />Agreement is current and in effect. <br />B. The parties wish to amend the Agreement to revise the S cope of Service and allow for substitute <br />instructors, as needed to provide the services. No other changes are contemplated by this <br />Amendment. <br />The Parties therefore agree: <br />1. Section 1.a., Scope of Services, is amended to replace Exhibit A to the Agreement with <br />Exhibit A-1 to this First Amendment and include Yonathan Hernandez and Baldwin Torres <br />as substitute instructors. <br />2. Section 2, Compensation, is amended to include: <br />C. Provider is responsible for payment to substitute instructors and Provider agrees that <br />City is not responsible for payment directly to substitute instructors. <br />3. Except as modified by this First Amendment, all terms and conditions of the Agreement shall <br />remain in full force and effect. <br />[signature page follows] <br />
