INC. FOR AN EVALUATION OF ENHANCED INFRASTRUCTURE <br />FINANCING DISTRICT AND A COMMUNITY FACILITIES DISTRICT <br />THIS FIRST AMENDMENT to the above -referenced agreement is entered into on September 28, <br />2023, by and between David Taussig and Associates, Inc., a California corporation dba DTA <br />("Consultant") and the City of Santa Ana, a charter city and municipal corporation organized and <br />existing under the Constitution and laws of the State of California ("City"). <br />RECITALS <br />A. The parties entered into Agreement No. N-2023-266, dated September 28, 2023, by which <br />Consultant agreed to provide evaluation for an enhanced infrastructure financing district and a <br />community facilities district ("Agreement"). <br />B. The Agreement is current and in -effect, and expires on September 27, 2024, with an option to <br />extend the term of the Agreement for an additional one-year period. <br />C. The parties now wish to amend the Compensation section in the Agreement to increase the <br />total not -to -exceed amount due under the Agreement. No other changes are contemplated by <br />this First Amendment. <br />The Parties therefore agree: <br />Section 2.a., Compensation, is amended to increase the not -to -exceed amount by an <br />additional $20,000 for a total not -to -exceed amount of $50,000 under the Agreement. <br />2.
