Adopt an urgency ordinance by four­fifths (4/5) vote, <br />pursuant to California Government Code Section 65858(a), adopting a 45­day <br />moratorium on the approval, commencement, establishment, relocation or <br />expansion of industrial uses within Specific Development No. 84 zoning district. <br />ORDINANCE NO. NS-3063 entitled AN URGENCY INTERIM ORDINANCE OF <br />THE CITY OF SANTA ANA PURSUANT TO GOVERNMENT CODE SECTION <br />65858 ADOPTING A 45­DAY MORATORIUM ON THE APPROVAL, <br />COMMENCEMENT, ESTABLISHMENT, RELOCATION OR EXPANSION OF <br />INDUSTRIAL USES WITHIN SPECIFIC DEVELOPMENT NO. 84 ZONING <br />DISTRICT <br />2. Find that, in accordance with the California Environmental Quality Act (CEQA), <br />the proposed action is not subject to the requirements of the California <br />Environmental Quality Act, pursuant to (Guidelines) Section 15060(c)(2) because <br />the activity will not result in a direct or reasonably foreseeable indirect physical <br />change in the environment and 15060(c)(3) because the activity is not a project as <br />defined in Section 15378 of the CEQA Guidelines, California Code of Regulations, <br />Title 14, Chapter 3, because it has no potential for resulting in physical change to <br />the environment, directly or indirectly and so is not a project. <br /> <br />MINUTES: Planning Manager Ali P Pezeshkpour provided a presentation regarding the <br />Transit Zoning Code 45-Day Moratorium. <br /> <br />Councilmember Bacerra spoke in support of the item. <br /> <br />Councilmember Penaloza spoke in support of the item. <br /> <br />Councilmember Hernandez spoke in support of the item. <br /> <br />Councilmember Lopez thanked staff for the presentation and spoke in support of the item. <br /> <br />Mayor Amezcua spoke in support of the item. <br /> <br />MOTION: Councilmember Bacerra moved to approve the recommended action <br />for Item No. 28, seconded by Councilmember Penaloza. <br />
