MISCELLANEOUS PROFESSIONAL LIABILITY <br />MPL 99 02 0318 <br />THIS ENDORSEMENT CHANGES THE POLICY. PLEASE READ IT CAREFULLY. <br />NON -CLINICAL SOCIAL WORKER <br />CHANGE ENDORSEMENT <br />This endorsement modifies insurance provided under the following: <br />Miscellaneous Professional Liability Insurance Policy <br />SECTION III — EXCLUSIONS, Section A.1 of the <br />policy is deleted in its entirety and replaced by the <br />following: <br />The Company Is not obligated to pay Damages or <br />Claim Expense or defend Claims for or arising <br />directly or indirectly out of: <br />1. Bodily Injury or Property Damage, except this <br />exclusion does not apply to Damages or Claim <br />Expense for Bodily Injury or Property Dam- <br />age arising out of the Insured's performance of <br />Insured Services, <br />SECTION III — EXCLUSIONS, Section A of the <br />policy Is amended to add the following: <br />A. The Company is not obligated to pay Dam- <br />ages or Claim Expense or defend Claims for or <br />arising directly or indirectly out of: <br />Administration or monitoring of detoxification <br />programs. <br />Diagnosing, failing to diagnose or prevent, <br />preventing or treating any mental illnesses <br />Prescription, sale or dispensing of over-the- <br />counter or prescription drugs. <br />SECTION III — EXCLUSIONS, Section A.5 of the <br />policy is deleted in its entirety and replaced by the <br />following: <br />The Company is not obligated to pay Damages or <br />Claim Expense or defend Claims for or arising <br />directly or indirectly out of: <br />S. Harassment, misconduct or discrimination <br />because of or relating to: <br />a. Race, creed, color or age; <br />b. Sex, sexual preference, national origin <br />or religion; or <br />c. Handicap, disability or marital status, <br />but only if the harassment, misconduct or <br />discrimination was knowingly committed, as <br />evidenced by any judgment, final adjudica- <br />tion, alternate dispute resolution proceeding <br />or written admission by the Insured. Pursu- <br />ant to SECTION 11— LIMITS OF <br />INSURANCE, RETENTION AND <br />REIMBURSEMENT, Section C. of this poli- <br />cy, the Company shall have a right to reim- <br />bursement of any Damages or Claim Ex- <br />pense paid by the Company as a result of a <br />Claim to which this exclusion applies. This <br />exclusion shall not apply to any actual or al- <br />leged sexual misconduct, sexual abuse, <br />and/or child abuse. <br />SECTION 11 — LIMITS OF INSURANCE, <br />RETENTION AND REIMBURSEMENT, Section <br />A.3., Sub -Limits, of the policy is amended to add the <br />following: <br />Sexual Harassment <br />The most the Company will pay for all Damages <br />and Claim Expense for Claims alleging sexual <br />misconduct, sexual abuse, and/or child abuse others <br />shall be $ 250,000 , no matter how many: <br />(1) Insureds this policy covers; <br />(2) Claims are made; <br />(3) Persons or organizations make Claims; or <br />MPL 99 02 0318 Page 1 of 2 <br />
