<br />Department of Treasury (“Treasury”) to provide funding for a number of different <br />programs, including the Coronavirus State Fiscal Recovery Fund and the <br />Coronavirus Local Fiscal Recovery Fund, together known as the Coronavirus State <br />and Local Fiscal Recovery Funds (“CSLFRF”), to provide monetary support to <br />local governments to respond to, mitigate, and recover from the COVID-19 public <br />health emergency. The City has determined that this Agreement is a permissible <br />use of CSLFRF funds. <br />21.3 As applicable, Grantee shall comply with all federal requirements including, but <br />not limited to, the following: <br />a. <br />of ARPA; <br />b. Treasury <br />https://www.govinfo.gov/content/pkg/FR-2022-01-27/pdf/2022-00292.pdf; <br />c. Treasury Compliance and Reporting Guidance for ARPA, available at <br />Sections 602 and 603 of the Social Security Act as added by Section 9901 <br />Final Rule for ARPA,available at <br />https://home.treasury.gov/system/files/136/SLFRF-Compliance-and-Reporting- <br />Guidance.pdf; <br />d.2 C.F.R. Part 200 – Uniform Administrative Requirements, Cost Principles, <br />and Audit Requirements for Federal Awards, other than such provisions as the <br />Treasury may determine are inapplicable to the CSLFRF program and subject to <br />such exceptions as may be otherwise provided by the Treasury; and <br />e.Treasury Coronavirus Local Fiscal Recovery Fund Award Terms and <br />Conditions, available at <br />https://home.treasury.gov/system/files/136/NEU_Award_Terms_and_Conditions. <br />pdf <br />21.4 With respect to any conflict between such federal requirements and the terms of <br />this Agreement and/or the provisions of state law and except as otherwise required <br />under federal law or regulation, the more stringent requirement shall control. <br />22.COMMUNITY WORKFORCE AGREEMENT <br />If applicable, the CONTRACTOR shall adhere to the CITY’S Community Workforce <br />Agreement (CWA), a pre-hire collective bargaining agreement, which establishes the labor <br />relations policies and procedures for CONTRACTOR to follow in the crafts persons <br />employed to complete the WORK OF IMPROVEMENT as more fully described in the <br />CWA. The CWA may be found on the City’s website at: http://www.santa- <br />ana.org/pwa/documents/CWA.pdf <br />23.CALIFORNIA AIR RESOURCES BOARD COMPLIANCE <br />Contractor shall comply, and shall ensure all subcontractors comply, with all applicable <br />requirements of the most current version of the regulations imposed by California Air Resources Board <br />(“CARB”) including, without limitation, all applicable terms of Title 13, California Code of <br />Regulations Division 3, Chapter 9 and all pending amendments (“Regulation”). <br />Throughout the Project, and for three (3) years thereafter, Contractor shall make available for <br />Page 10 of 12
