h. Arising out of infringement of, or any other violation relating to copyright, patent, trademark, trade secret or
<br /> other intellectual property right.
<br /> However, this Paragraph h. does not apply to:
<br /> (1) Infringement of copyright, trade dress or slogan, committed in your advertisement; or
<br /> (2) The unauthorized use in your advertisement of another's idea for an advertisement;
<br /> i. Committed by an insured whose business is:
<br /> (1) Advertising, broadcasting, publishing or telecasting;
<br /> (2) Designing or determining content of websites for others; or
<br /> (3) An Internet search, access, content or service provider.
<br /> However, this Paragraph i. does not apply to Paragraphs 18.a., 18.b. and 18.c. under SECTION VII —
<br /> DEFINITIONS. For purposes of this Paragraph L, the placing of frames, borders or links, or advertising for
<br /> you or others anywhere on the Internet, is not by itself considered the business of advertising, broadcasting,
<br /> publishing or telecasting;
<br /> j. Arising out of an electronic chatroom or bulletin board the insured hosts, owns, or over which the insured
<br /> exercises control; or
<br /> k. Arising out of the unauthorized use of another's name or product in your e-mail address, domain name or
<br /> metatag, or any other similar tactics to mislead another's potential customers.
<br /> 19. Pollution
<br /> a. Any liability arising out of the actual, alleged or threatened discharge, dispersal,seepage, migration, release
<br /> or escape of pollutants, anywhere at any time, whether included in a product or otherwise.
<br /> However, this exclusion does not apply to the extent underlying insurance provides coverage for liability
<br /> described in Paragraphs (1) through (6) below. Coverage under this policy will be no broader than that
<br /> provided by underlying insurance.
<br /> (1) Bodily injury if sustained within a building which is or was at any time owned or occupied by, or rented
<br /> or loaned to, any insured and caused by smoke, fumes, vapor or soot produced by or originating from
<br /> equipment that is used to heat, cool or dehumidify the building, or equipment that is used to heat water
<br /> for personal use, by the building's occupants or their guests;
<br /> (2) Bodily injury or property damage arising out of heat, smoke or fumes from a hostile fire;
<br /> (3) Bodily injury or property damage arising out of the escape of fuels, lubricants or other operating
<br /> fluids that are needed to perform normal electrical, hydraulic or mechanical functions necessary for the
<br /> operation of mobile equipment or its parts if such fuels, lubricants or other operating fluids escape
<br /> from a vehicle part designed to hold, store or receive them. This exception does not apply if the bodily
<br /> injury or property damage arises out of the intentional discharge, dispersal or release of the fuels,
<br /> lubricants or other operating fluids, or if such fuels, lubricants or other operating fluids are brought on
<br /> or to the premises, site or location with the intent that they be discharged, dispersed or released as part
<br /> of the operations being performed by such insured contractor or subcontractor;
<br /> (4) Bodily injury or property damage sustained within a building and caused by the release of gases,
<br /> fumes or vapors from materials brought into that building in connection with operations being performed
<br /> by you or on your behalf by a contractor or subcontractor;
