WHEREAS, pursuant to the California Environmental Quality Act ("CEQA"), City <br />Staff determined the adoption of the SAVZ Plan ("Project") is exempted pursuant to <br />Section 15061(b)(3) of the State CEQA Guidelines (14 CCR§ 15061(b)(3)), that CEQA <br />applies only to projects which have the potential for causing a significant effect on the <br />environment, and City Staff found that there is no possible significant effect directly <br />related to the Project. Furthermore, CEQA Guidelines Section 15262 applies, as the <br />Project is a study for possible future actions, which would be subject to independent <br />review. Finally, CEQA Guidelines Section 15276 applies as the Project is a <br />transportation improvement plan, but individual projects developed as a result of the <br />Project will be evaluated individually. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA <br />ANA, RESOLVES AS FOLLOWS: <br />Section 1. The City Council finds that all of the facts set forth in the Recitals of <br />this Resolution are true and correct. <br />Section 2. The City Council hereby approves and adopts the Santa Ana Vision <br />Zero Plan, a copy of which will be on file at the offices of the Public Works Agency of <br />the City for public inspection. <br />Section 3. The City Council has reviewed the Project and, based upon the <br />whole record before it, in the exercise of its independent judgment and analysis, <br />concurs that the adoption of the SAVZ Plan is exempt from consideration under the <br />CEQA") pursuant to CEQA Guidelines Section 15061 (b)(3) because it can be seen <br />with certainty that there is no possibility that the adoption of this Plan, in and of itself, <br />may have a significant effect on the environment; future projects described within the <br />Plan may be subject to independent environmental review pursuant to CEQA; the Plan <br />is a transportation improvement plan and any projects developed as result will be <br />evaluated individually; and therefore no further action is required under CEQA at this <br />time. <br />Section 4. The Executive Director of Public Works shall, pursuant to this <br />Resolution, be authorized to apply on the City's behalf for grant funding related to the <br />Santa Ana Vision Zero Plan. If such application is accepted, the Executive Director will <br />present the grant award to the City Council for approval. <br />Section 5. The Executive Director of Public Works shall be responsible for <br />monitoring, implementing and delivering periodic updates regarding the SAVZ to the <br />Environmental and Transportation Advisory Committee. <br />Section 6. If any section, subsection, sentence, clause, phrase or word of this <br />Resolution is for any reason held. to be invalid by a court of competent jurisdiction, such <br />decision shall not affect the validity of the remaining portions of this Resolution. The City <br />Council hereby declares that it would have passed and adopted this Resolution, and each <br />and all provisions hereof, irrespective of the fact that one or more provisions may be <br />declared invalid. <br />Resolution 2024-019 <br />Page 2 of 3 <br />
