ORDINANCE NO. ~B-255 REGULATING THE SALE 01~ UNCLAIMED <br />PROPERTY IN TP~ OF THE 'POLICE DEPART~ENT <br /> <br />THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWB: <br /> <br />SECTION 1. That Section 2612 of Part l, Chapter 6, Article II <br />of the Santa Ana Municipal Code is hereby amended to read as follows: <br /> <br /> "SECTION 2612. Disposal of u.nclaimed Property. <br /> <br /> Whenever unclaimed property found, necovered or held by the <br /> Police Department shall accumulate to the point where the Chief of <br /> Police desires to dispose of same, it may be sold after complying <br /> with the provisions of Section 1873 of the Civil Code of the State <br /> of california, as follows: Such property must be held by the <br /> Police Department for at least 6 months, must be sold at public <br /> auction to the highest bidder, notice cf such sale shal i be given <br /> by the Chief of Police at ]east 5 days before the time fixed for <br /> sale by publication once in the newspaper publishing City legal <br /> notices, and complimuce shall be had with any .amendment of said <br /> Section 1873. Property held for an individual finder, other than <br /> a City employee who found same while performing his regular duty, <br /> shall be returned to finder on demand if he has complied with the <br /> requirements of the Civil Code governing the duties, and obligations <br /> of a fir~ler, and no such p~operty shall be sold~Athout giving 5 <br /> day's notice by mail to the person turning it in, if such person <br /> gave an address. After said notices are given the sale shall be <br /> conducted by the Purchasing Agent. Property for which no bid is <br /> made at such sale may be given to a nonprofit charitable corpora- <br /> ~ton or destroyed as the Chief of Police may direct." <br /> <br /> SECTION 2. The Clerk of the Council shall certify to the passage <br />of this Ordinance and shall cause the same to be published once within <br />15 days after its adoption. This Ordinance shall take effect 30 days <br />from and after the date of its adoption. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa Aha <br /> <br />at <br /> <br />ATTEST: <br /> <br />its regular meeting held on t he ~rd d~ <br /> <br /> <br />
