ORDINA~CE NO. NS-256FIXING PROCEDU~ REGARDING BROKASqS' <br />C0~.~MISSIONS ON TH-~LE OF CITY-O~VNED REAL PROPERTY <br /> <br />THE CITY COUNCIL OF ~HE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: <br /> <br />SECTION 1. That Part l, Chapter 6 of Article II of the Santa Ana <br /> <br />Municipal Code is hereby amended by adding two new sections at the end <br />thereof, immediately following Section 2614, in words and figures as <br /> <br />follows: <br /> <br />"SECTION 2615. Agent's Commission on Sale. <br /> <br /> The Council, when it determines that auy real property <br />owned by the City should be disposed of, may authorize the <br />execution of a written listing contract to find bidders with <br />a licensed real estate agent or broker, and may specify that <br />said property be placed in Multiple Listing under said con- <br />dition, and shall specify the maximum commission to be paid <br />if the property be sold, which said commission shall in no <br />case exceed 5% of the sale price. No personal liability shall <br />attach to any agent of the City who signs any such contract <br />on behalf of the City." <br /> <br />"SECTION 2616. PsFment and Division of Commission. <br /> <br /> In event an agent covered by a contract, as set out in <br />Section 2615, procures a bidder who submits the highest writ- <br />ten bid and to whom the sale is made at the Council meeting <br />and completed in due course, the commission provided in said <br />contract s~hall be paid to said agent. In event such highest <br />w~itten bid conforms in all respects to the City's invitation <br />to bid and the provisions of Section 2613, and an oral bid <br />conforming to said requirements is made before the Council <br />and results in the sale being made and completed to said oral <br />bidder, then one-half of the commission originally fixed shall <br />be paid to the agent who procurred the original highest written <br />conforming bid. If the successful oral bidder was procured <br />and is represented by a licensed real estate agent or broker <br />and t he sale is made and completed, then the other one-half~ <br />of said commission shall be paid to such agent or broker~ <br /> <br />SECTION 2~ The Clerk of the Council shall certifyto the passage of <br /> <br />this Ordinance and shall cause the same to be published once within <br /> <br />days after its adoption. This Ordinance shall take effect 30 days f~om <br /> <br />and after the date of its adoption. <br /> <br />PASSED AND ADOPTED by the City Council of the City of Santa Ana at <br /> <br />its regular meeting held on the <br />ATTEST: <br /> <br /> CLERK OF ~}{E COUNCIL <br /> <br />day of June~, ~.Q57. ~ <br /> <br /> <br />
