ORDINANCE NO. NS-262ADDING A NEW SECTION TO THE <br />SANTA ANA MUNICIPAL CODE TO PLACE A TI~E LIMITATION <br />ON THE EFFECTIVENESS OF ANY VAMIANCE DUBING WHICH <br />THE USE PERMITTED MUST BE STARTED <br /> <br />WHEREAS, after notice and hearing the Planning Commission <br /> <br />recommended to the City Council an amendment to provide time limits- <br /> <br />tions on Variances which are not used, as hereinbelow set out; and <br /> <br />WHEREAS, the Council, after notice and hearing, have concluded <br /> <br />that said amendment to the zoning provisions of the City should be <br /> <br />enacted; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL 0¥ THE CITY OF SANTA A~ DOES <br /> <br />ORDAIN AS FOLLOWS: <br /> <br />SECTION 1. That Chapter 1 of Article IX of the Santa Aha Muni- <br /> <br />cipal Code is hereby amended by adding a new section, to be numbered <br /> <br />Section 9114.3, immediately following Section 911~.2, in words and <br /> <br />figures as follows: <br /> <br /> "SECTION 9114.3. Same. Time Limitations. <br /> <br /> A Variance approved by City Council in accord~ce with the <br /> procedures and considerations as provided in Section 9114 to <br /> Section 9114.2, shall automatically become void after six (6) <br /> months from the effective date of such approval, when the own- <br /> eP fails to institute an action to erect, build, alter, move <br /> or maintain the use of the property as specified in the terms <br /> and conditions of the Variance. <br /> Acceptable action shall be deemed to be actual construction, <br /> alteration, repair ~d use of structures and land. <br /> <br /> Preparation of plans, financial negotiations, estate settle- <br /> ments, or change of property owners, are nS considered suf- <br /> ficient evidence of an action. Howeve~ applicant may apply <br /> to the Planning Commission for a ninety (90) day extension of <br /> time, at an additional fee of five dollars ($5.00) for each re- <br /> quest of extension of time." <br /> <br /> SECTION 2. The Clerk of the Council shall certify to the passage <br />of this Ordinance a~d shall cause the same to be published once within <br />15 days after its adoption. This Ordinance sh~l take effect 30 days <br />from and after the date of its adoption. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa Aha <br /> <br />at its regular meeting held on the <br />ATTEST: <br /> <br />l?th day of June ., 19~. <br /> <br /> · MAYOR J <br /> <br /> <br />
