ORDINANCE NO. NS-389 ADDING MEW SECTIONS TO THE SANTA <br />ANA ~Ui~ICIPAL CODE TO REGULATE THE LICENSING OF PAWNBROKERS <br /> <br />~AGtEREAS, the business of pawnbroking has, in many instances, <br /> <br />been a source of trouble to local governmental agencies and particu- <br /> <br />larly to law enforcement of ficers throughout this State and elsewhere, <br />and in many areas is leading to dangerous, undesirable, unfair and <br />in some cases, unlawful practices by the operators of pawnbroking <br /> <br />establishments, to the detriment and injury of the citizens, and <br /> <br />the Council has determined the desirability of regulating such es- <br /> <br />tablishments in the City of Santa Ana; <br /> <br />NOW, THEP~FORE, THE CITY COUNCIL OF THE CITY OF SANTA ~A <br /> <br />DOES ORDAIN AS FOLLOWS: <br /> <br />SECTION 1. That Article VI, Chapter 3, Part 9 of the Santa <br /> <br />Ana t.,~unicipal Code is hereby ~uended by adding new Sections immed- <br /> <br />lately following Section 6391.4 in words and figures as follows: <br /> <br />"Section 6391.5. Definition. <br /> <br />For the purposes of this Part, every person <br />in Section 21000 of the Finauce Code of the <br />California shall be deemed a pawnbroker. <br /> <br />as defined <br />State of <br /> <br />Section 6391.6. Application for Certificate. <br /> <br /> Every person desiring to engage in the business of a <br /> pawnbroker shall first make written application to <br /> the Chief of Police of the City, stating his name, age, <br /> residence address, proposed business address, the busi- <br /> ness addresses of all other businesses in which he has <br /> an interest, a statement of the time, place and circum- <br /> stances of each and eve~ time he has been arrested for <br /> any purpose, a statement of the number of employees he <br /> will have in such place of business, the names and ad- <br /> dresses of such employees then known to applicant, and <br /> shall submit himself and each of said employees for the <br /> purpose of having photograohs and fingerprints taken. <br /> <br />Section 6391.7. Granting and Revoking Certificate. <br /> <br />If the Chief of Police finds that the applicant or any <br />proposed employee has been convicted of a violation of <br />any statute of this State or Ordinance of this City, <br />regulating pawnbrokers, or has been convicted of any <br />crimes involving theft, embezzlement, fraud or false <br />pretenses, or moral turpitude, he shall refuse to issue <br />a Certificate directed to the Finance Officer authorizing <br />him to accept payment of a business license tax from <br />applicant. Any Certificate issued hereunder may be re- <br />voked for any reason which would justify a refusal to <br />issue the s~me. No person shall carry on the business <br /> <br /> <br />
