ORDINANCE NO. NS-554 AMENDING SANTA ANA MUNICIPAL <br />CODE S~CTIONS 9324., 9324.1., 9324.2. AND 9324.3. <br />RELATING TO ALLEYS <br /> <br />THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: <br />SECTION 1: That Sections 9324., 9324.1., 9324.2., and 9324.3. of the <br />santa Ana Municipal Code are hereby emended in words and figures as <br />follows: <br /> <br /> SECTION 9324. Provisions for Alleys -Master Plan. <br /> <br /> Alleys shall be required where so indicated on any <br /> adopted Element of the Master Plan. <br /> <br />SECTION 9324.1. Provisions for AlLeys - Primary Streets. <br /> <br /> Alleys shall be required in the rear of lots fronting <br />directly upon any street designated as a primary street <br />on the Streets and Highways Map of the Streets and Highways <br />Element of the Master Plan. <br /> <br />SECTION 9324.2. Access to. Alleys. <br /> <br /> An alley required by this Chapter shall be, upon its <br />improvement, immediately accessible from a public street <br />or a private street constructed to City standard. <br /> <br />SECTION 9324.3. Exceptio~ to Alley Provisions. <br /> <br /> The City Council may waive any alley requirement provided <br />for in Section 9324., Section 9324.1., or Section 9324.2. of <br />this Chapter, if, in the opinion of the City Council, said <br />requirement is impractical and unreasonable due to such <br />factors as the existing development adjacent to the property <br />being subdivided, flood control channels or ditches, railroad <br />tracks, or topographic conditions such as abrupt changes in <br />the elevation, any one Of which precludes the logical and <br />practical extension of such required alley. If the owner <br />proposes that a required alley be waived, said proposal shall <br />be in writing and submitted at the time the preliminary map <br />or tentative tract map is submitted to the Planning Department <br />for processing and shall stipulate therein the reasons why <br />said alley requirements should not be imposed. The Planning <br />Director shall, in his formal letter to the City Council, <br />recommend adherence to or the waiving of such required alley. <br /> <br />SECTION 2: This Ordinance shall take effect thirty (30) days from and <br />after the date of its adoption. <br /> <br />PASSED AND ADOPTED by the City Council of the City of Santa <br /> <br />Aha at its regular meeting held on the 18th day of December, 1961. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br />-1~ <br /> <br /> <br />
