ORDINANCE NS-704 AMENDING SECTION 2612 OF <br />PART 1, CHAPTER 6, ARTICLE II OF THE SANTA <br />ANA MUNICIPAL CODE REGULATING DISPOSAL OF <br />UNCLAIMRD PROPERTY <br /> <br /> THE CITY COUNCIL O~ THE CITY OF DANTA ANA DO~ ODi)AIN Aa <br />FOLLOWS: <br /> <br /> SECTION 1: That Section 2612 of the Santa Aha Municipal <br />Code is hereby amended to read as follows: <br /> <br />SECTION 2612. Disposal of Unclaimed Property. <br /> <br /> Whenever unclaimed property found, recovered or held <br />by the Police Department shall accumulate to the point <br />where the Chief of Police desires to dispose of the <br />same, it may be sold after cc~plying with the provisions <br />of Section 1873 of the Civil Code of the State of <br />California as the same now exists or may hereafter be <br />amended, and provisions of this Section shall not <br />prevail insofar as they may be inconsistent with State <br />statutes. <br /> Such property must be held by the Police Department <br />for at least six (6) months, except unclaimed bicycles <br />shall be held for a period of at least three (3) months. <br />Such property must be sold at public auction to the <br />highest bidder. Notice of such sale shall be given by <br />the Chief of Police at least five (5) days before the <br />time fixed for sale by publication once in the newspaper <br />publishing City legal notices. <br /> Property shall be returned to finder on demand if he <br />has complied with the requirements of the Civil Code <br />governing the duties and obligations of a finder, and no <br />such property shall be sold without giving five (5) days <br />notice by mail to the person turning it in, if such <br />person gave an address. <br /> After said notices are given, the sale shall be con- <br />ducted by the Purchasing Agent or, with the approval of <br />the City Manager, some other City employee or employed <br />professional auctioneer. Property for which no bid is <br />made at such sale may be given to a nonprofit charitable <br />corporation or destroyed as the Chief of Police may <br />direct. <br /> <br /> SECTION 2: That this Ordinance shall take effect thirty (30) <br />days from and after the date of its adoption. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 6th day of January, 1964. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br />STATE OF CALIFORNIA) <br />COUNTY OF ORANGE ) <br />CITY OF SANTA ANA ) <br /> <br />SS <br /> <br /> I, DORIS M.
