ORDINANCE NS-759 DECLARING THE RESULT OF THE <br />CANVASS OF THE RETURNS OF THE ELECTION IN THE <br />TERRITORY KNOWN AS "SANTA CLARA AND TUSTIN <br />N. W. ANNEXATION" AND APPROVING THE ANNEXATION <br />OF SAID TERRITORY TO THE CITY OF SANTA ANA <br /> <br /> WHEREAS, heretofore a petition was presented to the City Council <br />requesting that certain territory herelnbelow described be annexed <br />to the City of Santa Ana under the provisions of the Annexation Act <br />of 1913, and the City Council, on June 1, 1964, adopted Resolution <br />64-84 expressing its consent to the commencement of proceedings under <br />said Act; and <br /> <br /> WHEREAS, thereafter a notice of intention to circulate a <br />petition for said annexation was regularly published, affidavit of <br />publication was filed with the Clerk of the Council and, on June 15, <br />1964, the City Council adopted Resolution 64-90 acknowledging receipt <br />of said affidavit of publication and accc~apanying documents and <br />approving the circulation of the petition for annexation; and <br /> <br /> WHEREAS, thereafter a petitionwas regularly circulated and <br />filed with the City Council representing more than one-fourth of <br />the qualified electors residing within said territory, and on <br />July 6, 1964, the City Council adopted Resolution 64-102 declaring <br />intention to call a special election in said territory on the <br />question of annexation and fixing the day and hour for filing and <br />hearing of protests to said election on the part of owners of <br />property within said territory; and <br /> <br /> WHEREAS, at 7:30 P.M. of the 3rd day of August, 1964, the day <br />and hour so fixed, no protest had been filed and no person was there <br />present to file any written protest or speak against said annexation, <br />and the City Council then adopted Resolution 64-114 declaring that a <br />majority protest had not been made against the election or the <br />annexation of said territory; and thereafter said City Council <br />adopted Resolution 64-117 calling a special election to be held in <br />said territory on October 13, 1964, which said Resolution made all <br />provisions for the holding of said election and which said election <br />was regularly held on said date. <br /> <br /> NOW, rfHEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />DOES OR~AINAS FOLLOWS: <br /> <br /> SECTION 1: That a special election was regularly held on the <br />13th day of October, 1964, after due and regular proceedings and on <br />proper notice, within the territory hereinbelow described; that the <br />votes cast thereat were duly and regularly canvassed and the returns <br />thereof were made at the time and in the form and manner required <br />by law; that one absent voter ballot was cast and was duly canvassed <br />and counted as required by law; that the City Council has duly <br />canvassed the returns of said election and from said returns and <br />canvass it appears, and this Council finds, that the proposition or <br />measure submitted to the vote of said electors was in words as <br />follows: <br /> <br />Shall "SANTA CLARA AND TUSTIN N.W. : YES : : <br />ANNEXATION" be annexed to the City : <br />of Santa Ana, California? : NO : : <br /> <br />that the total number of votes cast at said election was fifteen (15), <br />including one absent voter ballot; that fifteen (15) votes were <br />cast in favor of said proposition and that no votes were cast against <br /> <br /> <br />
