ORDINANCE NS-977 AMENDING THE SANTA ANA MUNICIPAL <br />CODE BY AMENDING SECTION 4220 OF PART 2, CHAPTER 2, <br />ARTICLE IV THEREOF RELATING TO FORTUNE TELLING <br /> <br /> WHEREAS, Section 4220 of the Santa Ana Municipal Code contains <br />provisions which have recently been held elsewhere to be too inclusive, <br />and which, therefore, violate the United States Constitution; and <br /> <br /> WHEREAS, it is desired to attach certain conditions and limi- <br />tations to the provisions of Section 4220, to render it acceptable; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That Section 4220 of Part 2, Chapter 2, Article IV <br />of the Santa Ana Municipal Code is hereby amended to read as follows: <br /> <br />Section 4220. Fortune Telling. <br /> No person shall follow the calling or avocation of palmistry, <br />fortune telling, clairvoyance, mental telepathy, astrology, or <br />any other calling or avocation by which such person claims to <br />tell the past act or history of another person or who claims to <br />foretell or prophesy the future acts or life of another person <br />for a consideration. <br /> <br /> The provisions herein contained shall not be construed to <br />include, prohibit, or interfere with the exercise of any religious <br />or spiritual function of any priest, minister, rector, or an <br />accredited representative of any bona fide church or religion, <br />where such priest, minister, rector or accredited representative <br />holds a certificate of credit, commission, or ordination under the <br />ecclesiastical laws of a religious corporation incorporated under <br />the laws of any state or territory of the United States of America, <br />or any voluntary religious association, and who fully conforms to <br />the rights and practices prescribed by the supreme conference, <br />convocation, convention, assembly, association, or synod of the <br />system or faith with which they are affiliated. Provided, however, <br />that any church or religious organization which is organized for <br />the primary purpose of conferring certificates of commission, <br />credit or ordination for a price, and not primarily for the purpose <br />of teaching and practicing a religious doctrine or belief, shall <br />not be deemed to be a bona fide church or religious organization. <br /> <br /> SECTION 2: That this Ordinance shall take effect thirty days <br />from and after the date of its adoption. <br /> <br /> PASSED AND ADOPTED by the city Council of the City of Santa Ana <br />at its regular meeting held on the 18th day of August, 1969. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COLfNCIL <br /> <br />MAYOR <br /> <br />-1- <br /> <br /> <br />
