ORDINANCE NS-1000 AMENDING CHAPTER 5 OF THE <br />SANTA ANA MUNICIPAL CODE BY AMENDING SECTION <br />5-64 OF ARTICLE II THEREOF PERTAINING TO <br />KENNEL REQUIREMENTS <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br /> <br /> SECTION 1: That the Santa Ana Municipal Code is hereby <br />amended by amending Section 5-64 of Article II thereof to read <br />in words and figures, as follows: <br /> <br /> Sec. 5-64. Kennels. <br /> <br /> All kennel pens must be securely enclosed with a wire <br /> fence not less than six feet (6') in height. All houses for <br /> sleeping must have a floor elevated at least six inches (6") <br /> above ground level; must have a cement floor; must be tight <br /> against the elements, except for the entrance; and must <br /> comply with the requirements of the Building Code. At least <br /> 100 square feet of securely fenced run area must be provided <br /> for each dog. <br /> <br /> No person shall allow the runs to become a nuisance in <br /> any manner and all dog fertilizer and food scraps must be <br /> cleaned up and removed at least once each day. All barking <br /> or howling dogs shall be kept in an enclosed room with insulated <br /> walls to prevent the travel of sound at an objectionable level <br /> from the kennel building. <br /> <br /> No kennel which contains or is designed to contain more <br /> than twenty (20) dogs shall be established when any part of <br /> the kennel buildings or runs is closer than five hundred feet <br /> (500') to any building used for human habitation. <br /> <br /> No kennel which contains or is designed to contain at <br /> least four (4) but not more than nineteen (19) dogs shall be <br /> established if any part of the kennel buildings or runs is <br /> closer than three hundred feet (300') to any building used <br /> for human habitation. <br /> <br /> No kennel shall be established which contains only three <br /> (3) dogs when any part of the kennel buildings or runs is <br /> closer than two hundred feet (200') to any building used for <br /> human habitation. <br /> <br /> The development and occupation of buildings for human <br /> habitation within the distances prescribed above by others <br /> than the kennel owner or operator or grantees, directly or <br /> indirectly, from or through the kennel owner or operator <br /> following the proper establishment of kennels, shall not <br /> render the maintenance of such pre-existing kennels unlawful <br /> by reason of the diminished separation of the kennel use and <br /> the use of buildings for human habitation. <br /> <br /> The residence of the kennel operator or owner shall not <br /> be deemed a building used for human habitation within the <br /> language of this Section. <br /> <br /> SECTION 2: That this Ordinance shall take effect thirty <br />days from and after the date of its adoption. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 19th day of January, 1970. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br />MAYOR <br /> <br /> <br />
