Such written complaint must be signed by at least two unrelated <br />persons over the age of eighteen (18) years and shall set forth (1) <br />the names and addresses of the complainants; (2) the reasons for the <br />complaint; (3) the name and address of the owner of the dog; (4) the <br />time and place the acts complained of occurred; and (5) a listing of <br />any damages which resulted, if any. <br /> <br /> The Animal Control Man shall serve a written notice of such <br />complaint and alleged facts on the person owning such dog by delivery <br />to him, or to some person over the age of eighteen (18) years, at the <br />address of the owner, or, if no such person is found, by affixing such <br />written notice securely to the door of the building at such address, <br />or by sending a copy thereof by mail to said address. <br /> <br /> Said notice shall contain the information that a complaint has <br />been filed with the Animal Control Man regarding the nuisance and <br />shall invite the owner to come to the Animal Control Division of the <br />Santa Ana Police Department and inspect said written report. <br /> <br /> After service of notice by the Animal Control Man, the owner <br />shall thereafter keep said dog securely confined within an adequate <br />enclosure, or on a leash; if the complaint be that the dog was bark- <br />ing or howling, the owner shall keep said dog in a manner so as to <br />prevent such barking or howling. <br /> <br />Sec. 5-61. Response and Impoundinq. <br /> The owner of a dog concerning which a complaint has been made <br />in writing may submit to the Animal Control Man his written report <br />in response to that of the complainant. Such response to the complaint <br />may set forth (1) the owner's name and address; (2) the owner's view <br />of the facts or series of events which caused the original complaint; <br />and (3) an agreement to abide by all existing City ordinances. <br /> <br /> The written response will be filed with the complaint and will <br />be shown to any party named in the reports who requests to see them <br />at the Police Department. <br /> <br /> Should the Animal Control Man receive a second complaint as <br />provided in Section 5-60 of this Code, it shall be his duty to <br />investigate and he may cite the alleged violator. <br /> <br />Sec. 5-62. Inspection Permit Requirement. <br /> <br /> No person shall establish, operate, maintain, or have a <br />commercial kennel within the City without an inspection permit. <br /> <br />Sec. 5-63. Application Procedure. <br /> Any person desiring the issuance of an inspection permit for a <br />commercial kennel within the city of Santa Ana shall make application <br />to the Finance Department of the city on such forms as may be provided. <br /> <br /> Upon such application being made, a non-refundable payment of <br />Thirty Dollars ($30.00) shall be made. Said payment is intended to <br />defray the expense of the City in causing the inspection to be made. <br /> <br /> The City shall cause an inspection to be made of the premises <br />intended to be used or being used as a commercial kennel. If such <br />inspection reveals that the use of the premises for any such purpose <br />would not be detrimental to the public health, peace, safety, and <br />general welfare of the city nor violative of any law or ordinance <br />of the City, nor of any law of the State of california, or allow a <br />condition to be maintained which would subject animals in such <br />condition to needless suffering, unnecessary cruelty, abuse, or <br />unsanitary conditions, the City may grant and issue said inspection <br />permit. <br /> <br />-10- <br /> <br /> <br />
