ORDINANCE NS-1032 REGULATING COMMERCIAL MANURE <br />DEALERS AND REQUIRING THEIR REGISTRATION <br /> <br /> WHEREAS, the City of Santa Aha and the County of Orange are <br />endeavoring to control the proliferation of flies; and <br /> <br /> WHEREAS, in order to complete registration in this area it <br />is felt that not only producers of fly breeding materials, but also <br />those who deal therein must be regulated as well; and <br /> <br /> WHEREAS, commercial manure dealers must be identifiable in <br />order that their activities might be examined and regulated; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That Chapter 18 of the Santa Ana Municipal Code <br />is hereby amended by adding Sections 18-351 and 18-352 to read in <br />words and figures, as follows: <br /> <br />Sec. 18-351. Commercial Manure Dealer - Definition. <br /> <br /> COMMERCIAL MANURE DEALER shall mean any person, firm, or <br />corporation who, for a fee, gathers, collects, hauls, stock- <br />piles, spreads, or sells any manure or manure-like substance <br />other than in a fully composted and bagged condition. <br /> <br />Sec. 18-352. Reqistration. <br /> It shall be unlawful for any commercial manure dealer to <br />gather, collect, haul, stockpile, spread or sell any manure <br />or manure-like substance within the City of Santa Ana without <br />first registering with the County Health Officer on forms <br />prescribed by him. Such registration shall expire at the end <br />of each calendar year and shall be renewed annually during the <br />first week in January. There shall be no fee for such registra- <br />tion nor any subsequent renewal. <br /> Failure to register as a commercial manure dealer as provided <br />in this Article shall constitute a misdemeanor punishable, upon <br />conviction thereof, by a fine not exceeding five hundred dollars <br />($500.00) or imprisonment in the County Jail for six months, or <br />by both such fine and imprisonment. <br /> <br /> SECTION 2: That this Ordinance shall take effect thirty days <br />from and after the date of its adoption. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of Santa <br />Ana at its regular meeting held on the 17th day of August, 1970. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br />MAYOR <br /> <br />-1- <br /> <br /> <br />
