ORDINANCE NS-1037 ADDING AN ADDITIONAL <br />GROUND TO DISQUALIFY APPLICANT FOR DRIVERtS <br />PERMIT <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS <br />FOLLOWS: <br /> <br /> SECTION 1: That Section 38-12 of the Santa Ana Municipal <br />Code is hereby amended to read as follows: <br /> <br />Sec. 38-12. Same -- Consideration and standards for determination. <br /> <br /> On filing an application, applicant shall be fingerprinted, <br />and a check shall be made to determine whether or not applicant <br />has a prior criminal record. Before issuing any temporary <br />permit the police department shall check local records, require <br />applicant to pass an examination as to his knowledge of city <br />streets, and determine that applicant possesses a valid and <br />proper driver's license from the state of California. <br /> <br />No driver's permit shall be issued by the police department <br />any person: <br /> <br />(a) Who is under the age of twenty-one (21); <br /> <br />(b) Subject to apoplexy, fainting or loss of consciousness <br /> by reason of chronic medical conditions; <br /> <br />(c) Who is addicted to the use of narcotics; <br /> <br />(d) Who is known to have been a user of hypnotic drugs or <br /> alcohol to an excessive degree; <br /> <br />(e) <br /> <br />Whose driving record indicates five (5) violations of <br />traffic laws involving moving vehicles within two years <br />preceding the date of application; <br /> <br />(f) <br /> <br />Who has wilfully furnished false information on his <br />application or omitted to furnish all information requested <br />on said application form; <br /> <br />(g) <br /> <br />Who has been convicted for driving while under the influence <br />of intoxicating liquor or narcotic drugs, or both, within <br />five (5) years of the date of application; or <br /> <br />(h) <br /> <br />Who has been convicted of a felony or of any crime <br />involving moral turpitude within five (5) years preceding <br />the date of application. <br /> <br /> The foregoing disqualifications are subject to appeal to the <br />City council as provided in section 38-15 of this chapter. <br /> <br /> SECTION 2: That this Ordinance shall take effect thirty <br />days from and after the date of its adoption. <br /> <br /> PASSED AND ADOPTED by the City Council of the city of Santa <br />Ana at its regular meeting held on the 21st day of September, 1970. <br /> <br />ATTEST: <br /> <br />CLERK OF THE COUNCIL <br /> <br />MAYO R <br /> <br />-1- <br /> <br /> <br />
