ORDINANCE NS-1081 AMENDING THE SANTA ANA <br />MUNICIPAL CODE BY AMENDING CHAPTER 12 <br />THEREOF BY ADDING ARTICLES II AND III <br />PROVIDING FOR REGULATION OF THEATERS <br /> <br /> THE CITY COUNCIL OF ~THE CITY OF SANTA ANA DOES ORDAIN <br />AS FOLLOWS: <br /> <br /> SECTION 1: That Chapter 12 of the Santa Ana Municipal <br />Code is hereby amended by adding~Article II thereto to read <br />in words and figures, as follows: <br /> <br />ARTICLE II - PEEP SHOW ESTABLISHMENTS <br /> <br />Section 12-21. Peep Show Establishments: Purpose and Intent. <br /> <br /> It is the purpose and intent of the City Council that <br />the operation of peep show establishments, as defined in this <br />code, should be regulated for the protection of the public from <br />the perils of fire, hazard to health, and for the preservation <br />of the peace of the community. <br /> <br />Section 12-22. Definitions. <br /> <br /> (a) "Peep show establishment" shall mean any place in which <br />a peep show device is operated. <br /> <br /> (b) "Peep show device" shall mean an aperture through which <br />may be viewed images that are exhibited by means of the pro- <br />jection or internal electronic reflection of motion picture <br />film, or slides, or both. <br /> <br />Section 12-23. Permit. <br /> <br /> No person shall operate a peep show device unless a permit <br />for the operation of said device has been issued by the Finance <br />Department of the City and remains in effect in conformity with <br />the provisions of this Code. <br /> <br />Section 12-24. Permit Term. <br /> <br /> No permit shall be issued by the Finance Department for a <br />period in excess of six (6) months. The expiration dates of <br />said permit shall be June 30th and December 31 of each year. <br /> <br />Section 12-25. Permit Fee. <br /> <br /> Every person owning or operating a peep show device shall <br />pay a fee of twelve dollars ($12.00) per six (6) months' period <br />for each peep show device. Any person applying for a permit <br />for a period of less than six (6) months shall pay a prorated <br />fee. <br /> <br />Section 12-26. Applications for Permit - Investiqation Fee. <br /> <br /> Ail applications for a permit, or for the renewal of a <br />permit, shall be accompanied by an investigation fee in the <br />sum Of ten dollars ($10.00). In the event the permit is granted <br />or renewed, the sum shall be applied to the permit fee as <br />described in Section 12-25. In the event such permit is denied, <br />said application fee shall be and become the property of the <br />City of Santa Ana. <br /> <br />- 1 - <br /> <br /> <br />
