ORDINANCE NS-1119 REPEALING AND RE-ENACTING <br />SECTION 16-7 OF ARTICLE I, CHAPTER 16 OF THE <br />SANTA ANA MUNICIPAL CODE RELATING TO THE <br />AUTHORITY OF PUBLIC OFFICERS OR EMPLOYEES TO <br />ISSUE CITATIONS <br /> <br /> WHEREAS, the City Council has determined that the <br />Department of Public Works is to have the power to issue citations <br />in their enforcement of garbage, trash, weed ordinances. The <br />Public Works Department has been so restricted under the existing <br />section as to have virtually no citation power at all. <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That Section 16-7 of Article I, Chapter 16 <br />of the Santa Ana Municipal Code is hereby repealed and re-enacted <br />to read as follows: <br /> <br />Sec. 16-7. Authority of public officers or employees <br /> to issue citations. <br /> <br /> The following designated public officers and employees <br />shall have the power to make arrests or in lieu thereof <br />issue citations as provided by Section 836.5 of the <br />California Penal Code for violations committed in their <br />presence hereinafter provided: <br /> <br />(1) <br /> <br />The director of public works, the assistant director <br />of public works, the construction engineer and all <br />sanitation inspectors shall have the power to issue <br />citations for any violations of sections 16-1 through <br />16-4, 16-33, 16-34, and 16-48 of this chapter. <br /> <br /> SECTION 2: That the Clerk of the Council shall certify <br />to the passage of this Ordinance and cause the same to be published <br />in some daily newspaper printed and published in the City of <br />Santa Ana. <br /> <br /> SECTION 3: That this Ordinance shall take effect <br />thirty days from and after the date of its adoption. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of <br />Santa Ana at its regular meeting held on the l~%h day of <br /> , 1972. <br /> <br />ATTEST: <br /> <br />MAYOR <br /> <br />CLERK OF THE~ COUNCIL <br /> <br />STATE OF CALIFORNIA) <br />COUNTY OF ORANGE ) <br />CITY OF SANTA ANA ) <br /> <br /> I, FLORENCE I.
