SECTION 8: The Santa Ana Municipal Code is hereby amended <br />by adding a Section to be numbered Section 8-111, which said Sec- <br />tion reads as follows: <br /> <br />Sec. 8-111. Refunds (Sec. 303(g) ) <br /> <br /> Sec. 303 of the Building Code is amended by adding subsec- <br />tion (g) at the end thereof to read as follows: <br /> <br /> Sec. 303(g) Refunds. Upon written request from the per- <br />mittee, refunds of building permit fees may be made to the per- <br />mittee in an amount equal to 80% of the building permit fee paid; <br />except that no permit fees shall be refunded under any of the <br />following circumstances: <br /> <br />1. If the building permit fee is $5.00 or less. <br />2. After one year has elapsed from the date of the <br /> issuance of the permit. <br />3. If any inspections have been performed by the <br /> Department of Building Safety and Housing. <br /> <br />If a permit has been issued for a project located in an area out- <br />side of the jurisdiction of the City, 100% of the building permit <br />fee may be refunded. If a duplicate permit has been erroneously <br />issued, 100% of the duplicated permit fee and plan checking fee <br />may be refunded. In no other case shall any part of any plan <br />checking fee be refunded. <br /> <br /> SECTION 9: The Santa Aha Municipal Code is hereby amended <br />by adding a Section to be numbered Section 8-112, which said Sec- <br />tion reads as follows: <br /> <br />Sec. 8-112. Use and Occupancy (306(a) ) <br /> <br /> Sec. 306 (a) of the Building Code is amended to read as <br />follows: <br /> <br /> Sec. 306(a) Use or Occupancy. No building or structure <br />shall be used or occupied, nor shall such building or structure <br />be connected with permanent utility services until the Building <br />Official has determined compliance with this Code, all other <br />applicable ordinances and laws, and the conditions of the building <br />permit, and has authorized occupancy of such building or structure. <br /> <br />No existing commercial or industrial building whose electrical <br />service has been disconnected shall be reconnected with permanent <br />electrical service until the Building Official has determined that <br />the building does not constitute an unsafe building as defined by <br />Section 203. <br /> <br /> SECTION 10: Chapter 8, Sections 8-120, $-128, 8-129, 8-135, <br />8-140, 8-141, 8-145, and 8-146, inclusive, are hereby repealed. <br /> <br /> SECTION 11: Chapter 8, Sec. 8-156 of the Santa Ana Municipal <br />Code is hereby amended to read as follows: <br /> <br />Sec. 8-156. Pool Fence Required (Sec. 1507) <br /> <br /> Chapter 15 of the Building Code is amended by adding Section <br />1507 to read as follows: <br /> <br /> Sec. 1507 Fencing Required. Every swimming pool, pond, or <br />other body of water eighteen inches or more in depth at any point <br />shall be surrounded by a fence or wall not less than five feet <br />above the adjacent exterior grade.
