ORDINANCE NS-1149 AN ORDINANCE OF THE CITY COUNCIL OF SANTA ANA DECLARING THE NEED FOR A REDEVELOPMENT AGENCY TO FUNCTION IN THE CITY OF SANTA ANA CONTAINING A DECLARATION OF THE CITY COUNCIL OF SANTA ANA DECLARING ITSELF TO BE THE RE- DEVELOPMENT AGENCY WHEREAS, there exists within the City of Santa Ana blighted areas and deteriorated or deteriorating areas, as defined in Chapter 1, Article 3 of Part 1, Division 24 of the california Health and Safety Code, which Part 1 of said Division 24 is known as the Community Redevelopment Law; and WHEREAS, Section 33100 of the Community Redevelopment Law created in the City of Santa Aha a public body, corporate and politic, for the purpose of exercising the powers granted by the Community Redevelopment Law, but provided, pursuant to Section 33101 thereof that said public body, corporate and politic, shall not transact any business or exercise any po- wers unless by Ordinance the Council of the City of Santa Ana declares there is a need for such agency to perform; and WHEREAS, Section 33200 of the Community Redevelopment Law provides that as an alternative to the appointment of members of the Agency the Council of the City of Santa Ana may declare itself to be the Agency; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: It is hereby found and declared, pursuant to Section 33101 of the Community Redevelopment Law that there is a need for the Redevelopment Agency created by Section 33100 of said law to function in the City of Santa Ana, and said Agency is hereby authorized to transact business, and exercise its powers under the Community Redevelopment Law. SECTION 2: That the Council of the City of Santa Ana here- by declares itself to be the Redevelopment Agency, as provided in this Ordinance, and that all rights, powers, duties, privi- leges and immunities vested by the Community Redevelopment Law in such Agency shall be and are vested in this body. SECTION 3: That the Clerk of the Council shall certify to the passage of this Ordinance and cause the same to be pub- lished in some daily newspaper printed and published in the City of Santa Ana. SECTION 4: That this Ordinance shall take effect thirty days from and after the date of its adoption. ATTEST: MAYOR CLERK OF THE COUNCIL
