In the event that an application for a <br />Certificate of Public Convenience and Neces- <br />sity is denied by the City Council, such <br />applicant shall not apply for a certificate <br />of public convenience and necessity for a <br />period of one year following the date of such <br />denial. Any application filed within such <br />one-year period by an entity over which the <br />prior applicant has substantial control, or <br />by any corporation where such prior applicant <br />has a substantial ownership interest shall <br />be deemed to be filed by such prior applicant. <br /> <br />Section 38-9 - Certificate of Public Convenience <br /> <br />and Necessity-Transfer. <br /> <br />No certificate may be sold, assigned, mortgag- <br />ed, leased, or otherwise transferred without <br />the consent of the Council, nor shall any <br />stock be transferred in any corporation hold- <br />ing, any certificate be assigned, transfer- <br />red, sold, or hypothecated without the consent <br />of the Council. Violation of this section <br />shall constitute grounds for revocation of <br />the Certificate. <br /> <br />Section 38-10 - Certificate of Public Con- <br /> <br />venience and Necessity-Suspension and Revocation; <br />Appeal to Council. <br /> <br />A Certificate of Public Convenience <br />and Necessity issued under the pro- <br />visions of this chapter may be <br />revoked or suspended by the Chief <br />of Police, the City Manager or their <br />delegate if the holder thereof: <br /> <br />Violates any provisions of this <br />chapter. <br /> <br />Discontinues operation for <br />more than thirty (30) days. <br /> <br />Violates any ordinance or <br />statute of the State or the <br />United States, which violation <br />indicates the unfitness or <br />indifference of the holder <br />to offer safe and adequate <br />public transportation or would <br />constitute grounds for the <br />denial of the certificate. <br /> <br />-11- <br /> <br /> <br />
