the holder to select and employ drivers who are <br />familiar with the streets and addresses in the City <br />of Santa Aha. The employment by any holder of a <br />Certificate of Public Convenience and Necessity <br />of any person as a driver who has been convicted of <br />a felony or of driving under the influence of <br />intoxicating liquor or drugs, or whose record as <br />a driver of motor vehicles as r~lected by official <br />court and police records, shows a lack of mental, <br />emotional, moral or temperamental capability to <br />be a safe and reliable driver will be taken into <br />consideration by the City Council when requested to <br />grant or renew any Certificate of Public Convenience <br />and Necessity to operate vehicles for hire in the <br />City of Santa Ana. Every holder is enjoined not <br />to employ or retain in employment any person as a <br />driver who violates laws governing morals, motor <br />vehicle operations, or provisions of this chapter. <br /> <br />It shall be unlawful for any holder of a Certificate <br />of Public Convenience and Necessity in the City of <br />Santa Ana to employ a driver who has not first <br />been issued a driver's permit under the provisions <br />of this chapter, and a violation of this provision <br />shall be sufficient reason for revoking the <br />Certificate of Public Convenience and Necessity of <br />such holder. <br /> <br />Section 38-30 - Records and Reports - Required of <br /> <br />Ail Holders. <br /> <br />Every holder of a Certificate of Public Convenience <br />and Necessity under the provisions of this chapter <br />shall establish, keep and maintain a system of <br />records of such business and its operations. <br /> <br />Section 38-31 - Same-Periodic Examinations. <br /> <br />Accurate records of receipts from operations, <br />operating and other expense, capital expenditures <br />and such other operating information as may be <br />required by the Finance Director shall be kept and <br />maintained. Every holder of a Certificate of Public <br />Convenience and Necessity shall maintain the records <br />containing such information and other data required <br />by this chapter at a place readily accessible for <br />examination at all reasonable times by the Finance <br />Director, the Chief of Police or other authorized <br />representatives of the City of Santa Ana having a <br />legitimate and official interest in the enforcement <br />and administration of the provisions set forth in <br />this chapter. <br /> <br />Section 38-32 -Same-Monthly Re~orts. <br /> <br />Each holder of a Certificate of Public Convenience <br />and Necessity, not later than the 15th day of each <br />calendar month, shall upon request of the Finance <br />Director file verified reports showing all <br />receipts for all operations during the calendar <br />month next preceding the month of report in connect- <br />ion with such service for which a Certificate of <br />Public Convenience and Necessity has been issued. <br />Every such report shall be supported by daily or <br />weekly records, driver's manifest and other data <br />if required by the Director of Finance, such records <br />and manifests, after inspection and auditing, to <br />be returned by the Director of Finance to the holder. <br /> <br />-21- <br /> <br /> <br />
